  • Cabot write to me after 15 years silence?

I have received a letter from Cabot financial enclosing a statement of account and a notice of arrears for just over 2k. It gives the original lender as Barclaycard & the b/c account number. I do remember defaulting on a b/c many moons ago and receiving various debt collector letters but nothing further in well over a decade, also no monies has been paid since default. They conveniently left the date account opened & closed box blank.

I rang Barclaycard just to get some info and the only thing they could tell me was the account was opened in Aug 1996 and was sold to Cabot in May 1999 and any queries I need to take it up with Cabot. My credit file is spotless clean.

I guess they must be hitting on hard times if they now after almost 15 years decide to write! Should I hit them with the SB letter?

If, as you say, NOTHING was paid since default (quoted as 1999), then I certainly would send them the letter! :thumb:

Cheers FP. Yes absolutely nothing paid and no contact with them for many, many years. 10000% SB. I do have old copies of CRA files which recorded the default and that dropped off donkeys years ago, but I'll keep tabs in case they do try to register another and tarnish my good name. Can I play with them a bit first before formally declaring SB.

You could ensure that they are acquainted with the retort in the celebrated (if unreported) case of Arkell v Pressdram. (link)

Arkell v Pressdram, I like it lol.
It does seem a bit of a coincidence that these people come out of the woodwork after all this time just as I'm helping another person with their debts and have given the dca my details as the 3rd party intermediary. If it's taken them 15 years to contact me then they can't be that bothered about the money.

After firing off a complaint I've received a letter from Cabot. They say the statement of account I received was sent in error due to a system error affecting a number of customer accounts. An isolated incident which management have taken measures to prevent any further reoccurrence and sincere apologies for any inconvenience or confusion caused. They confirm in 2006 the account was withdrawn from their collection process as they acknowledge the debt was stat barred and assure me I won't receive any further contact.

Cabot being reasonable, and admitting an error. Will wonders never cease.

(You wonder if they would have ever admitted that and stopped chasing had they not been told to "Arkell" )

It does make you wonder if it was a genuine mistake or perhaps a stab in the dark with the very old stat barred accounts just to see if any old debtors would cough up at the sight of their letter!

Exactly. It's a very convenient mistake.
