Thanks for the reply again.

I had a reply from Lloyds this morning, they sent me original CCA request and the £1 P.O back, the letter says :

"Unfortunately we are unable to accept this payment as :

"You have asked us to pay into a product we do not manage
The cheque / P.O is not made payable to us

Please send another cheque / P.O made payable to Lloyds TSB (a/c HPES) and quoting the loan agreement number if you still wish to pay this money into your loan. If you wish to call me my number is at the top of this letter.

Question is the CCA wasn't regarding a loan, it was regarding my CC, and the debt was passed to the debt recovery team at lloyds, also on the original CCA letter I sent them, and they returned they have wrote my bank account number next to the ref I gave for the DMP on my CC

Personally I'd try giving that person a call and see if you can clear up the misunderstanding.

Just spoke to someone at the CC dept of Lloyds who has said he has sent a email to request all my credit agreement, and I should get within 7-10 working days, waiting game begins again

Ok well keep on at them, Lloyds are legendary for making verbal promises on the phone and never sending the CCA response. My sister had them do it 3 times in 2009.

Thanks, will phone them if I haven't got it in a reasonable time, they not going to charge me the £1 then ? Also on the phone he asked why I wanted the CCA, I told him straight to see if I can claim PPI or any other charges

Technically...the s.78 request should produce

1. Copy of the original agreement and any terms referred to in it.
2. Copy of revised terms if applicable. (almost always yes)
3. Statement of account

This way you will be able to consider the circumstances you were sold the original product and also any PPI etc incorporated into the contract.

If you want a complete list of all charges/fees/PPI deductions made to the account over at least the last 6 years (hopefully further) the you need to do a Data Protection Act Subject Access Request in addition to your s.78 request. This will cost £10.
