      This is getting completely out of hand. Thank you for trying to keep this nonsense on track CB.

      Right FACT, LIAG. Our solicitors were part of these LEAD cases you refer to. The case management conferences for these 13 selected cases were held on 16th October 2009. hearings were in November 2009 and Judgment was handed down by HHJ David Waksman QC sitting in the Queens Bench Division Mercantile Court Manchester in December 2009. Perhaps you would like to study the reasons behind this issue.

      Read the WHOLE case and the WHOLE judgement particularly at sections 108 and sections 234. That lays out the obligations of a creditor with absolute clarity. It is only the bad advice of certain sectors of these forums which has allowed weak defences (and poorly advised ill thought claims) by LIPs to be defeated and a history of poor case law to be built up.

      So in line with Curlyben, get your facts right before advising others. You only have to ask properly here and you will get all the information you need if you are able to comprehend the meanings. The sort of thing that you have suggested here and elsewhere and the associated case histories is making the lives of the real professionals prepared to help us consumers in their battles with the OCs/DCAs infinitely more difficult.

      I sincerely hope that is not he case by design.
