    How intersting? Well Im going to wait the 12 days and see what happens. I believe once cabot have defaulted, I need to send them a 2nd letter regarding that.

      Hi All,

      Sorry to bother you all about this again, but if I put my details in online to cabot and offered them £1 a month ( this was after the first letter was received as was scared) does this mean I've acknowledged the debt to them? Remember, I have CCA'd them and the PO was returned and will still wait the 12 + 2d ays for a response.

      I think what I'm asking is, even though I offered to pay £1 a month online, are they legally allowed to make me pay THEM even though they haven't supplied me with the CCA?

            I received a letter from Cabot on Thursday stating Citi is experiencing a delay in retrieving the information from its archives. I have been waiting from Sep 2009 and nothing so good luck to Cabot!!

            Cabot are still adding interest though, from first contact from them 1 month ago their last letter states my balance has increased by £100.....

            Does anyone know if they are entitled to add interest to a debt that hasnt been proven to exist and for which no paperwork has been produced, not even an attempt to bluff me with a copy of T&Cs?

                Unfortunately Cabot are allowed to add interest as they have bought the debt. I have spoken to quite a few of the debt helplines and they have said because they have bought the debt, they are allowed to do so.

                Its happening to me aswell.

                What I have been advised to do is send them an I/E form with a letter asking to freeze interest explaing that you are facing financial hardship. If they refuse to do this, you can then get the FOS involved.

                Also, it will go in your favour if it goes to court, becuase the judge will see that you are facing hardship and that it would be impossible to clear this debt....

                  My problem with Cabot adding interest is that they have no paperwork to prove the debt exists and have admitted they are waiting for Citi to produce it, does this not make the account in dispute and leaving aside the fact that a disputed account should never have been sold in the first place, surely they are not allowed to add interest!!?

                  Are these scum allowed to do whatever they want and the courts will back them no questions asked.....

                    I have had the same letter from Cabot telling me they have recalled the dent from IMFS?

                    No idea who IMFS? Does anybody know IMFS
                    CITI confirmed they dont have a CCA? I have been making token payments to CITI due to financial hardship.
                    No letter from CITI telling me Cabot are dealing with debt.
                    Looks like Cabot are or have taken over a set of accounts and sending letters off the PC.

                    Should I carry on paying CITI direct?

                        Thanks....never paid IMFS never had a letter from IMFS....
                        Interesting that Cabot tell me that I paid them and told me to carry on paying them but now I dont have to pay them anymore....never had a letter from CITI telling me they have done anything with this account and no letters from CITI
                        Just Cabot.....no wonder I dont understand!

                          We had a letter back from Cabot (along with the £1 fee) saying that they did not realise that the account was already in dispute and that they would be asking Cit for copies of agreement (good luck been waiting over a year already)
                          They confirm that the account is "unenforceable" but again are trying to get us to contact them to make payments as "It has been established in English Law that "enforcement" constitutes obtaining a judgement in court. The reporting of a default entry to the Credit Reference Agency's or Cabot requesting repayment of your account does not amount to enforcements. "
                          They then invite us to contact them to make repayments.
                          Should we just sit tight to see if they do come up with this documentation or make token payments we would be unable to pay much as only one of us currently in work.

                            They have admitted that the debt is Unenforceable which means that they can do diddly squat about it only trash your credit files. Its up to your conscience whether you pay them anything. Remeber however that they bought this debt for about 10p in the pound and that the original creditor has long since written it off against their tax liabilities so in fact the only people at a loss are Cabot

                              Had a phone call from an 01142 number? a company called Ascent.
                              Refused to speak to them just said please put any queries in writing and put the phone down (do not even know if it was about Cabot)

                                I still haven't received a CCA from Cabot yet either and they have gone over their 12 days + 2...

                                However I did send my I/E from to them last week recoreded delivery and requested that they freeze the interest. Let see if they reply to this. I have to start paying them £1 from the 1st Nov, and find this annoying because of the added interest..

                                But hey, not sure what else I can do right now.
