      Well my letters look the same as yours except, my letter says that I should continue paying IMFS at the agreed rate..

      Funny that I have no idea who IMFS are lol....

      Kafka - the Citi supposed NOAs are in black and white and there are are bunch of reference letters which supprisingly link to the Cabot welcome letter ...

        Citi told me to stop payng them and to wait, then issued the default. Which is fine as I know you cannot be issued 2 defaults on the same account...

          Cabot are likely to take you to court over the debt, regardless as to whether you pay the £15 a month to them or not, so you can either do that to help the judge set installmnets at that rate on the CCJ, or just wait and do an offer to pay when the claim comes through.

          Citi telling you to stop paying doesnt sound right - if it does go further bring that up, also will need a record of all your payments.

          The NOA will be fine (batch run from Cabot) if you are concerned contact CItI and check with them..... I wouldnt get too sidetracked on it. Cabot are being quite forward at the moment with court action so if there is no dispute on the debt at all then I would be negotiating with Cabot for a freeze on any interest charges and an affordable repayment plan and take it from there.

            Hi Amethyst,

            I do have a copy of all my payments as I did a SAR with Citi last year....

            So are you saying that I should contact Cabot in writing and offer a payment?

            Or should I just go on line as they say I can and just offer a payment and start paying them?

            I wouldn't be in the position to ay £15 a month now, so it would be less as still out of work. Not fussed about going to court, just would rather do that before I find a job....

            There has been no extra charges on the account, as the interest has been frozen..

            Also, Cabot have not threatened me with court action, they have just asked me to get in touch to make arrangemnts to pay.

              I'd do that then, in writing, rather than through their online system though. Enclose a full Income/Expenditure sheet.

                Why not online?

                My finances are so bad that It would cost me to go to an internet cafe, ( no ink in printer and cannot afford) plus the cost of recorded delivery ect....


                At least if I do this online, I can start by making payments almost immediately...

                  Pen and paper is still acceptable lol, sorry, I know what its like I'm the same so people get handwritten letters from me these days.

                  I only say not online as I don't trust them and any record of your offer is only with them.

                      That sounds like an excellent plan Best of luck, keep us updated and if it progresses to court don't panic..just come and post the details. Keep a good record of all payments made.

                      Do you have all the original documents from the card (agreement/statements etc). It may be worth when you are able doing a CCA (consumer credit act) request to get the original agreement (cost £1), and a SAR (subject access request under the data protecton act) (cost £10) to get all your transactions (and reclaim any unfair charges added to the account which may reduce the outstanding balance) and anything else they hold on you - these requests would go direct to Citi, and may come in useful if this does progress to court proceedings.

                        Yes, I already have the SAR & CCA from Citi, which I sent for last year. All the details are correct.

                            Well,

                            I've just been onlione and have offered them a payment of £1 per month by Giro payments on the 1st of each month.

                            They have said that my proposal will be reviewed today and that someone will either contact me via email or post. I have told them I'm out of work, and they did not ask for an income and expenditure.

                            I'm hoping they will accept. But if they don't, I don't mind going to court as they can't take from me what I do not have. Fingers crossed for me everyone, and I will let you know the outcome.

                            Oh, and of course I will be sending a letter ( recorded) for backup....
