It seems Yorkshire waited as long as they could before either having to sell the debt or issue default. They just sold it instead of applying the default which then led to Cabot waiting another 8 months before finally adding the default. Should this have been applied earlier??

n your Credit File there are two defaults for the same account (1 debt)?
Is that correct? Can you get a print out?

Hi Echat thanks for your reply. No there aren’t 2 defaults. Just the one 12th May 2019 by Cabot.

O.K. but they haven't sent a copy in any of the information they've sent?

No notice of default and as far as I can remember I didn’t receive one in the post in 2019. They sent me a copy of original agreement, notice of assignment along with welcome to Cabot letter and a couple of balance statements. That’s it. Yorkshire SAR didn’t really prove anything new. Thanks again Echat.

I would wait to see what they do next.

And just to mention a previous default I had disappeared off credit karma on the exact date of the default 6 years later. So I was expecting this one to drop off a few days ago on the 12th and it didn’t. Still remains.

When you say wait to see what they do next. They sent me a letter last time saying the account is on hold until 2nd June but says return the I and E form before then.

You really need to decide what you want to do, set up a payment plan or let them issue proceedings and Defend on the grounds they haven't provided the correct documentation, i.e. Default Notice etc.

Is there anyway I can request that from them before they issue proceedings??

With or with out the Default Notice they may decide they have enough documents to start proceedings.
So asking for it won't stop them, but it gives you a valid Defence if they start proceedings i.e. you weren't sent it and they haven't provided a copy.

You won't get a CCJ, the only way you get a CCJ is if you ignore a Courts Judgement.
You won't do that, you'll have the opportunity of Mediation to resolve the matter.

Ok thanks Echat. I’ll have a little think about it. They have it on hold until 2nd June. Thanks again
