It seems Yorkshire waited as long as they could before either having to sell the debt or issue default. They just sold it instead of applying the default which then led to Cabot waiting another 8 months before finally adding the default. Should this have been applied earlier??

No notice of default and as far as I can remember I didn’t receive one in the post in 2019. They sent me a copy of original agreement, notice of assignment along with welcome to Cabot letter and a couple of balance statements. That’s it. Yorkshire SAR didn’t really prove anything new. Thanks again Echat.

You really need to decide what you want to do, set up a payment plan or let them issue proceedings and Defend on the grounds they haven't provided the correct documentation, i.e. Default Notice etc.Originally posted by SWA View PostWhen you say wait to see what they do next. They sent me a letter last time saying the account is on hold until 2nd June but says return the I and E form before then.

With or with out the Default Notice they may decide they have enough documents to start proceedings.Originally posted by SWA View PostIs there anyway I can request that from them before they issue proceedings??
So asking for it won't stop them, but it gives you a valid Defence if they start proceedings i.e. you weren't sent it and they haven't provided a copy.
