Hello all. It’s been a while but I need some advice again. Cabot were successful in gaining two ccj’s against me in 2008 for quite substantial amounts (£19k &£11k). For whatever reason they chose not to enforce the judgements within the six years. I’ve not moved house or evaded them in any way in this time. They have come out of the woodwork again demanding the full balance on both accounts, what are the chances of them successfully applying to the courts to enable them to enforce the original judgements ten years after they have lapsed? Typically I now own property which they could attempt to place a charging order on

Thank you for your response. They haven’t implied they will yet but given the amount involved I have a feeling they might. As much as it pains me I might have to offer a full and final settlement to make it all go away. This is the very last of the demons from a very very dark period in my life

The best thing is to wait.
But if you are minded to make a settlement, let it be on your terms, make low offers. The debts were bought for pennies, I'd be looking at no more then 5%, 10%. max. I can't see them going to Court.

That was my initial thought but I’m already losing sleep over it. In the limited communication I’ve had so far they have agreed that no ‘home visit’ which they originally threatened will happen as they have acknowledged that I have revoked their right of implied access. Let’s see what happens next

EXC ULA I believe ReahaTaul to be a bot, one of several that have been posting to the forum recently. Their posts appear benign but, as atticus pointed out in another thread, may not be entirely accurate. What’s your position regarding them? Do we report them?

Unfortunately, we know that non experienced users may try to respond on posts with an answer from ChatGPT or a similar AI tool. We need to be vigilant to this, as although it may be useful advise, in some instances it may be incorrect or an entirely inaccurate response based on English and Welsh law. Acknowledge Claim - within 14 days from Service
Defend Claim - within 28 days from Service (IF you acknowledged in time)
