  • Cabot CCA re Virgin CC

    Good morning,

    I was wondering if someone could take the time to give a bit of advice on the following;

    I sent Cabot a CCA request in November 2018 regarding a Virgin CC taken out in 2016, defaulted June 2017. I made payments to Cabot up until the CCA request was sent.

    Cabot replied that they could not locate the agreement and it was deemed unenforceable early 2019 and no further payments were made. I recently received a letter which states they enclosed the CCA and that it was now enforceable. They could go for a CCJ however would prefer to work with me etc.

    Could someone please have a look over it and advise if it is in fact correct and/or next steps? (attached to the post, personal details removed)

    On page two of the PDF it says you are: and has my correct name and address at the time.

    Also where it states about applying via Uswitch - I've never once used their services.

      As they appear to have the original credit agreement I'd ask them where proof of signing it is because as they say you applied through USwitch then they'll be bale to tell you when to the minute if you did.

      Send an Subject Access Request Letter to Virgin and USwitch, the Virgin one will forearm you shoudl they file a claim as to what information they might actually be able to get to support a claim and if USwitch can't provide data then that's a pretty big obstacle they're going to have to overcome.

        Thank you for the reply. Cabot have been getting pretty aggressive lately, latest threatogram gave me nine days before they explore different methods of collection and may send a doorstep agent to discuss.*

        Am I correct in assuming that they are still in default of my CCA request or is the one that they sent correct?

        Should I send Cabot a letter in the interim to tell them they are in default or that I am awaiting a response from Virgin?*

          You should send Cabot a letter asking for proof you entered into a contract via USwitch as they have alleged.
