  • Cabot Financial chasing 12yr old debt. Need advice

    Hi all,

    i have received a letter from Cabot chasing a debt of just over £17k stating that I owe the money and that a CCJ was issued back in 2010. Basically they bought a debt from some company back in 2007 when hey purchased it from GMAC. In July 2010 supposed legal action was taken against me and a CCJ was obtained in September 2010 which I have no knowledge of as that would mean that it would have been on my credit file up to 2016 and I know it wasn’t there.

    I asked Cabot to send me proof of the so called CCJ and they sent me a copy of the Claim Form which I have a few issues with. These are:-

    1: If it is mine, they’ve spelt my name wrong
    2: The address doesn’t exist as the street name and town are in Northern Ireland and the postcode is in Southampton. I’ve never lived in Northern Ireland.
    3: it isn’t signed anywhere on the claim form
    4: There no court seal stamp on the claims form
    5: Claimant name is MCE Portfolio and not Cabot Financial and that’s dated July 2010

    They said in the letter that this is heir final response under the terms of their complaints process and that they want me to call them to set up an affordable payment plan which of course aim not going to do

    i would love some advice on how to get these people off my back by either Financial Ombudsman, take them to court or just tell them to shove it as Ive had sleepless nights over this because they are relentless.

    Gosh so sorry to have missed your post - have you looked into this any further ?

    To enforce a CCJ after 6 years they would have to apply to court for permission - I think a letter back to Cabot at this stage telling them they are wrong and this is not your CCJ should start an investigation off. I'd also send a Subject Access Request to them to find out what other data they hold of yours and might show how this has ended up being linked to you.

    As it is over 6 years I don't think there is a great deal of point applying to set aside the original judgment - particularly before we know more information.
