Hi guys
I'm battling against Cabot and now Restons. I sent the 3 letter process and fee to Cabot they sent me dodgy paperwork, with no readable name and address, a so called copy of a Notice of Assignment which didn't state true intentions of letter, they refused a Deed of assignment. I also requested a Default Notice of which i never received. I have never acknowledged this debt to Cabot so they got Restons onto me. I received 1st threatening letter from Restons stating that I had not contacted their client and I was no longer entitled to any documents and to just pay up. I wrote to Restons giving them dates to all my correspondence and requests for further documents. They replied with a Notice of intention and stated that I was contradicting myself and stalling for time. I wrote them a lovely letter informing them of my intentions to see them in court and for them to make sure they have all the documents and my missing default notice. They gave me till June 24th to respond which I did and I've heard nothing since. It's now 6 weeks what are they up to please any advice would be grateful.

Tricky without knowing what the blanked out sections said, but the notice does look to be compliant from the point of view that it has all the words it should have. Did this notice go to the right address? Did this notice give 14 days from the day it was received to remedy the breach? These are questions that need to be answered.

Just checked Default date on Equifax it is from Cabot 31 March 2016. Nothing on report from Vanquish

Hi guys, finished stint of nights and almost as normal as I'm going to be. Is there any luck with the default letters or any thing else I can come back with. I need to write to them in the next couple of days,
I can question default dates but are the any problems with the letters.

Ha it is and I think its forecasting rain so not too bad on a night if raining in morning even better for trying to sleep, ha living the dream so they say lol

Ahh thank you Amethyst date alledge by default letter is around December 2015, yet on my default date by cabot 2017 on credit file, will sign up to Equifax tomorrow unfortunately going to work now but thanks again for info I will look into correct date from Vanquish

Hi guys, just to let those kind people helping me with this case, I'm about to get ready for a 12 hour night shift and wont be able to respond to any advice until about 4pm tomorrow I don't want to be seen as being ignorant thank you again for any help

Clearscore isn't great for showing default dates - I don't know Credit Wise - Credit Karma is good for that but some companies only report to Equifax and not Experian or Transunion, but some do report to them all - still worth checking - you'd expect the actual default date to be December 2015 or Jan 2016.
This is one of my old defaulted accounts on Credit Karma so you know what I'm on about... it actually defaulted in June 2015 but wasn't reported as defaulted by Cabot until Oct 2016. However it will still fall off the credit file in June 2021 ( 6 years from actual default )

Hi, thank you for replying, the front page says account sale agreement, it is dated 30/6/17, when Cabot purchased debt, it gives content page of about 50 clauses, it is dated on print at the bottom but the top isn't dated on the start of the agreement nor is the signatures, I would have thought a legal binding document would be dated when signed. Both credit reference I use clear score and credit wise state defaulted in both august and September 17, I do remember Vanquish being on clear score but no sign now. Thank you for passing defaults to your colleague, I really appreciate any help

Cabot didn't default the debt - Vanquis will have but not reported it and it only started being reported when Cabot took it over. The actual default date should be the date Vanquis defaulted the account. Which credit file are you looking at and where via? (Eg Experian via MSE credit club)
the copy default notices don't need to be on headed paper - just show the lender and your details and give st least 14 days to rectify ( and exclude the fca info sheet and certain text in capitals) which they seem to have done - pt2537 seemed to have some concerns over the default notice so tagging him to have a peek now we've got the full docs.
