  • Cabot and restons? help needed please court claim

    Each month i have tried to pay something off this months turn was cabot for £298 for a vanquis card debt they bought.
    i had ignored them to a degree until i had the money but have not seen a letter from restons....
    so this weekend after failure last week in paying online i managed to log in and pay the amount outstanding on cabots website which it gladly took.
    Then i called them this morning to say i paid this please confirm you have the email and a-m items ive asked for you to send or confirm a bit backwards but i asked them for proof , confirmation of pay and they havce updated my credit bureax account to state paid in full...lots of other things like ststements etc....
    ...they said yes paid but you needed to pay restons
    i said not sure who they are but you have the debt and i managed to log into your website it showed me i owed that amount and i paid it
    yes but you should have paid restons...
    at this point i had no more patience .
    so have i paid it in fiull or not?...
    yes but let me put you through to restons it is paid in full but had to be to them but it is done now
    ...so she put me through to them ...
    they then proceeded to try and get work,phone,landline,email ..
    .i said nope and no idea who you are...
    .then they said well we have now done a claim for a ccj and you owe more than this now....
    i said hell no ive not seen anything about this .
    .well you should in the next couple of days.....
    okay but it is paid...
    no it is not you owe fees and solicitors costs now....
    whaaattt..
    .just no it has not got to court yet....
    or even to me.........
    they disconnected the call then ...
    what should i do next?
    anyone got a template i can send to both with a formal wording which means bugger off? :P

    so update: i received their claim on tuesday also spoke to cabot, who very kindly told me they were going to esculate it as for some reason they had never sent out the notification to me to say it had been passed to a solicitors :O.... do i need to answer this as i paid before i received it ?
    Shall i send proof etc to all the restons directors cc in and main email name to npc@restons.co.uk? attaching the proof of payment and explaining protocol was not followed and can they now confirm they have cancelled this claim ?
    i found also all the directors names on companies house so will cc all of them in?
    I also will give them cabots complaint reference which should also show them a mistake was also made in not notifying me ...i mean how can one pay smeone you never heard about until this wek!

      What is the issue date on the Claim ?

      Had you received any letter before action at all from Restons or Cabot at all ? What was the last letter you had from Cabot ?

        Last thing i received was a letter from cabot in march they have told me for whatever reason they never sent me a letter after this to state it had gone to restons, totally admitted that, i called the court this morning and the issue date was 4th they say as the final date to submit a defense falls on a weekend the last day to do it is the 25th on the monday of june.
        I sent an email to restons and copied as many of the directors on as i could i have delivery proofs on my outlook but no ones actually done a read receipt lol

          I have given them until the 20th of june to cancel this , if they do not i will log in and do a defense , the lady i called at the court said it would be unlikely to be a ccj done as there is no debt

            Not sure on the court's Math's there - you need to acknowledge within 14 days from service ( 17 days from the issue date ) - and IF you do that it's extended to 28 days from service ( 33 days from issue date ). ( then best by 4pm Friday if the date is on a weekend but they allow 4pm the following Monday )

              I had a read receipt from restons and an email from cabot stating they did not tell me the debt was transferred t restons but so what it is and they have written to me they stated..... so ive filed acknowledgement and for more time so they both reply with my requested information! i paid it so all i am really defending is restons fees as they are still persuing instead of cancelling it...not my issue if cabot refuses to talk to restons and tells me to do it...why i did not instruct them surely it is their thing to do?
