    Hi Can someone advise me please ? I have received numerous pages of paper work from SHOESMITHS chasing me for a credit card debt from 2007.I had a STATUTE BARRED put on it 2 years ago because i genuinely cannot remember having this credit card ,even though SHOESMITHS have original paper work from CAPITAL ONE. Who in turn passed the debt over in 20015 to CABOT .SHOESMITHS have now notified me and stated that they are requesting that the STAY be lifted for reasons they have stated in there letter, which i dont understand ? I have never acknowledged this debt or made any payments .They are now taking it to court ?

    If they are lifting the stay it's already at court. It might be best to post a copy of the letter along with the documents with all personal information removed as then it can be translated from Legalese to English for you.

      They are only applying to the court to have it Lifted Its not in court yet .

      Defend Claim - within 28 days from Service (IF you acknowledged in time)

      If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
