You can submit a letter saying you won't be able to attend and why, and file a further witness statement asking for it to be taken into account.
Presumably you have exchanged witness statements with the other side ? Is there anything further you want to add to your argument ? Did the claimant provide further documents - default notice, agreement, notice of assignment etc ? - basically what would your arguments be on the day if you did attend ?

I've uploaded a defence to MCOL initially and the process was stayed - they've now paid to have the stay lifted and sent me documents as per your comment above and a hearing arranged.Originally posted by Amethyst View PostYou can submit a letter saying you won't be able to attend and why, and file a further witness statement asking for it to be taken into account.

Okay, what still stands from your defence ?
If there's nothing, and you think they will win, then you could just get in touch with the claimant and say now you've finally provided docs can we have a without prejudice discussion on settlement to avoid costs of court hearing etc .... and see if you can agree installments putting off the hearing and the claim on hold so you can make installments ( or full and final ) without having a CCJ awarded against you ?#staysafestayhome
