  • Help with form please - “Creditor’s Reply to Debtor’s Application to Vary Order”

    I wonder if someone would be able to advise me on what I need to do with this form, if anything?

    I agree with the debtors offer - am I right in my understanding that if I don’t reply to this then they will accept the debtors offer by default?

    Thanks for any help - I don’t want to ignore the letter just in case there is a requirement for me to reply, and I don’t want to risk messing up having the opportunity of accepting a payment plan!

          Hello again

          Despite replying to accept the offer above back in March, I’ve received the attached.

          Unfortunately it went to an address at which I’m not currently residing due to the C19 situation. Therefore I did not have opportunity to reply in time.

          Could anyone confirm to me exactly what the letter means? I’m hoping that I’m correct in my interpretation that in lieu of my reply, the order for payments as detailed will be made anyway?

            No, if you don’t confirm it then they can go back to court.

            Write to explain that you have had to temporarily live away from your home due to Covid-19, that you have received the order date X today and that para 2 is acceptable to you or not.

            it should then go back to court.

            Acknowledge Claim - within 14 days from Service

            Defend Claim - within 28 days from Service (IF you acknowledged in time)

            If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
