    Attended Court hearing, got an order from the judge, submitted my part of order but claimant discontinues, can i claim for costs and what is procedure please

    Good news Congrats.

    Just spinning that order for ease of reading ( other one is just claimant saying they're discontinuing ) - cause it's a good order How did you manage to get such an order off the Judge ? application or via your defence ? ( was the hearing the full hearing of the claim which ended up with the order, or an application hearing )



    You should be able to ask for wasted costs as a LIP. I'll check out the procedure.

      had notication from robinson way in aug saying case was on hold after cca 76 request for copy of agreement was awaiting, anyway checked with the court day before it was supposed to be heard, was told case was still on. Next day went to court appeared before judge who tried to get me to admit bank account was mine, but i contested i had bank account but the one mentioned doesnt relate to anything ime aware of, i had no overdraft facuility just a basic account, i said i requested the contract to prove the account was mine, judge said contracts can be verbal as well as written, i replied your honour banks dont give out bank accounts on verbal basis and i have no joinder or likening of minds with claimants in any way shape or form so on that basis i am unable to admit that the mentioned account belongs to me as I've had a few bank accounts, he paused listend to the claimants then said "the court orders that ......... as was written,
      i returned my witness statement part of which is attached, gotta mention a special thanks to claimants solicitor, i learnt a lot from thier witness statement and learnt how to present my defence better after hearing her converse with the judge. If i hadn't denied owning the account to the judge i believe it would have been awarded to claimant and i would have been found guilty with an award of 1500 plus against me.

        I believe that to open a bank account requires you to jump through a number of regulatory hoops due to money laundering checks. An account without such checks would not be possible.

        Acknowledge Claim - within 14 days from Service

        Defend Claim - within 28 days from Service (IF you acknowledged in time)

        If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
