        **UPDATE**We received a letter from the court on the 4th August saying, "I acknowledge receipt of your defence. A copy is being served on the claimant (or the claimants solicitor). The claimant may contact you directly to attempt to resolve any dispute. If the dispute cannot be resolved informally, the claimant will inform the court that he wishes to proceed. The court will then inform you of what will happen.Where he wishes to proceed, the claimant must contact the court within 28 days after receiving a copy of your defence. After that period has elapsed, the claim will be stayed. The only action the claimant can then take will be to apply to a judge for an order lifting the stay".I guess we'll just wait now to see what happens.

          This morning we received a Directions Questionnaire (small claims track) but still have not received any proof of the debt, not sure what to do now. They are requesting mediation but my wife is nervous that they will try to talk her into a debt that she has no recollection of or that they can prove. Any help will be greatly appreciated.

            So I would agree to mediation, agree to small claims track and also put witnesses as 1 - your wife (maybe even 2 if you will attend) [MENTION=6]Amethyst[/MENTION]?

            Remember , mediation is some way off and you do not talk directly to the solicitor, it is more like a 3 way phone call with the mediator talking to you then them then you again etc. Saying yes to mediation now doesn't mean you have to go through with it.

              OK but how does it work with them still not providing any evidence at all of this phantom debt? Surely it's not right to put someone through the process of mediation when they haven't even backed up their claim of a debt?

                Before mediation you get a form to fill in about the appointment for mediation which asks if you have all documents / information you need to mediate ... if you still have nothing you say no. If they don't send that ( they don't always) then when you speak to mediator you'd tell them the same and the call would end.

                It's useful to have mediation in the pipeline though in case docs all show up and you need to negotiate xxx

                  Great thanks. So she should just fill out the questionnaire and send it off? Then wait to hear hopefully from mediation about the appointment?

                        *UPDATE*
                        We have received a Small Claims questionnaire fromy the court to fill out.
                        It asks to fill out full name and all contact details which is fine but it also says to send a copy of the questionnaire to all parties. This would provide Lowell with more contact details which they don't currently have, to hound us about a debt they still have yet to provide any evidence of. Can anyone give us any advice with this please? Do we just fill out the forms and send a copy to them a requested or blank out our contact details on the Lowell copy?

                            It's a 'Directions Questionnaire' (Small Claims Track. What I'm worried about is that if it gets thrown out because they have not provided any proof of anything, that they have more ways to hassle us in the future.

                              slow down.calm down nothing gets thrown out, but at this stage you will agree to mediation when asked and then if you do not have the necessary paperwork to continue you will in inform the mediator when asked that NO you do not have the necessary paperwork from solicitors, they then will state no mediation can take place and pass the case back to the court system whereby later you will inform court of the latest situation in statements when the court ask


                              As this is now a court case the case is run by court not solicitors.

                              take it slowly from now on and do not panic ask here before you do anything?
