        Does that mean the contract was not binding until it was signed by Vanquis?

        i’m still confused about contacting Lowell to try to resolve this without going to court.
        If I phone them and offer to pay anything, wouldn’t that be an admission?

          Shoud the documents have been sent to me before they were used as exhibits?
          If the Claimant has disclosed documentation since you filed your Defence (late disclosure) then consider whether an Amended Defence is what's needed since you appear to have only pleaded "no documents" as a Defence and you may need to plead new legal arguments as well as file a WS.

            Good evening

            I called Lowell to see if I can arrange an instalment plan. They said they I can set up a Tomlin Order for the value of the claim and the fees + an additional £100 to set up the Tomlin Order. They said I would need to tell them my household income and expenditure in order to write up the order for me to sign. They said it needs to be agreed by the court. He also said that a Tomlin Order could be granted at the hearing
            Is this all correct?

            Defend Claim - within 28 days from Service (IF you acknowledged in time)

            If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
