  • Court claim help - Arrow Global

    I received a court claim at Northampton county court. I used your website which advised me to send the CPR 31.14 request to Restons I received no response. I also sent arrow global a letter asking for the consumer credit agreement also with no response. I then sent my defence stating that I had no response which they said they would forward to arrow global I have now received a letter from arrow global which said the following: IMG_0394.jpg

    How should I respond to this?

    Hi

    Well for a start I would make sure you include that letter in your witness statement, if they are not the creditor how can they bring a claim.

    Can you give us a bit of background
    What were the particulars of claim - can you the them out word for word

    What did you ask for in your CPR31.14 request ? Was the template you used from here

    If it was not mentioned in the claim form, when was the O/D defaulted- that is quite important because, I think after 2012 they had to provide terms and conditions when they renewed the O/D on an annual basis

        Hi again

        When did you last use the OD, can you remember?

        have you sent a SAR to HSBC
        I know you have already done the defence but it might throw some light on the finer details

        I would also be sending a Part 18 request specifically for the formal demand which the bank should have sent you and the deed of assignment which is what they need to prove they own the debt

        The only downside here is as it is a relatively small amount and they refuse to provide the details , unless you are on a low income and qualify for fee remission , it will cost something like £255 to force the issue and for that you could probably settle at mediation.

          Hi,
          I can't remember exactly but it would have been roughlly around 2012.
          No I haven't sent a SAR to HSBC? Could you provide me with a template?
          Who do I send the Part 18 to?
          How much do you need to earn to qualify for free remission?

            For the avoidance of doubt, and as stated above, this Subject Access Request requires disclosure of ALL personal data which you hold on me for the entire period of my dealings with you

            I enclose the statutory maximum fee of £10. You have 40 calendar days in which to comply

            If you have had previous addresses you could include list them here

            If there is specific information which you require in order to satisfy yourself as to my identity, please let me know by return.

            If I do not hear from you then I will assume that this Statutory Request is satisfactory and that the 40 day timescale has started.

            There are lots and lots of versions of Subject Access Request templates on the internet ,


            You would send a part 18 request to the solicitors but they need wording carefully and correctly, they must be for something specific
