    Hi Mousey.

It is difficult to give an indication as to what may or may not occur, or to give you any kind of considered opinion, really.
We don't know the exact wording of the Particulars of Claim.
We don't know the wording you used in defence of it.
I, for one, am assuming that the CCA request was ok, but I don't know for sure.
Have you sent the CPR request & SAR?
Have you checked the current status of the claim?

      Re: Bw legal/ lowell

What is the SAR please? I sent a letter asking for the credit agreement to Lowell and one to BW asking for the Agreement/contract, default notice, assignment and formal demand, to enable me to file my defence.

MCOL can be a bit glitchy.
If necessary you can email them.
But for general queries on the progression of the case, I usually 'phone.

                    Re: Bw legal/ lowell

Ive spoken to a lady at the court she told me to email them the reason Im defending my claim being due to insufficient evidence the debts mine. As BW havent continued with it yet I was still ok to do this. She doubts it will go any further as its a small amount but recommended I sent them this so I dont end up with a CCJ. So Ive done that now.
Ive been trying to work out how to put images of the letters Ive received on here from my ipad but cant do it can anyone help with this please?

Feel free to email them to me admin@legalbeagles.info if that is simpler.

There shouldn't be any need to email the court. You've already submitted your defence which says clearly the reason you are defending. In fact as you have received the cca now then I wouldn't do so as it could instigate Lowell/BW applying to lift the stay to continue the claim. The claim is currently stayed so until they ask to proceed you shouldn't do anything, other than research the documents they have sent you and prepare for your defence should they decide to pick it up again.

Apparently Id only acknowledged the claim online, so Ive emailed them now, I suppose I could say I hadnt received the cca yet? I didnt have to sign it was just sent in the normal post? The adviser doubts it will go any further as its not a big amount. Yeah Ill email you the letters Ive had if thats ok thanks do I need to cover personal details up?

Yes please, but if you are struggling on the ipad I can do it for you.

Quite lucky the case had been stayed if your defence hadn't been submitted - phew !

And no, you couldn't say you haven't received the CCA yet now, as you have, but we'll have a look at it as you might have other arguments there.
