      ONLY LIST HERE DOCUMENTS THAT ARE MENTIONED IN THE PARTICULARS OF CLAIM ON THE FRONT OF THE CLAIM FORM - eg. IF THEY DON'T MENTION ' DEFAULT NOTICE' YOU CANNOT ASK FOR IT UNDER CPR 31.14, IF THEY MENTION CONTRACT rather than AGREEMENT - ask for the CONTRACT...IF IN DOUBT TYPE OUT THE PARTICULARS OF CLAIM AND ASK ON THE FORUM.( and remove this paragraph too!!!!)
      for EXAMPLE
      1. Agreement / Contract
      2. Default Notice
      3. Assignment
      4. Formal Demand

              You should also send a CCA request, as non-compliance with it bars enforcement.

                CCA £1 fee
                CPR 31.14 £1 fee
                SAR £10 fee
                To Mortimer clarke

                do i need to send these also to cabot?
                sorry to sound stupid

                also can they all go in same envelope to mortimer clarke?

                    have sent off CCA & CPR 31.14 and also sar to capital 1, just going through the letters again it seems strange that the letters MC have sent state capital 1 default notice was 27/6/2011, but the letter (cap1) telling me my account was sold to cabot was dated 19/10/15 also the letter from cabot assignment of account to cabot was also 19/10/15 surelly there would be a week or so inbetween dates doesnt seem to make sense (letters are in post above)

                              I see no Default Notice, only a letter informing you that you have been defaulted and they have terminated your account. Obviously that would come after any DN which would give you the opportunity to remedy the breach before defaulting you.

                              I love the last paragraph of Mortimer Clarke's letter which says:" We consider that the agreement is now enforceable. If you disagree please explain why."

                              I think the boot is on the other foot because they're going to have to explain to the court why they think they've satisfied your s.78 CCA Request with that bunch of eclectic paperwork.
