I have just had a call from Restons and they have agreed the Tomlin Order.They said I will receive 3 copies in the post I need to sign them send them back with a fee of £100. . . .

. . . with regards to the court papers.In fact they said I could do nothing with them but must sign the papers and return with the fee.

They seem very keen for you to sign on the dotted line all of a sudden, when last week they were expressing their preference for a CCJ. I wonder what's caused that change in attitude.

So you sent a CCA Request and the response from Restons was to call you to agree a Tomlin Order. Did you negotiate a good discount on the debt?

Is there a deadline for signing the Tomlin Order by which the offer would be withdrawn if unsigned? If not then you can take your time while you see if they can comply with your CCA Request (and your CPR 31.14 Request too).

If they can't comply with your CCA Request then the debt is unenforceable in court which may help you to renotgotiate the terms of that Tomlin Order (unless they've made you an offer you can't refuse).

File your Defence by the deadline and stay off the phone. Everything must be in writing.

Too Keen for them to sign - alarm bells of faulty case here be careful do not give in unless you are sure 100% they have a real chance of winning and the correct documents, they thrive on scaring people to submit and then plunder the savings for their coffers (illgotton) some of these so called Legal firms are on the brink of Corruption.

I didn't even know I could negotiate a settlement in fact the amount is more as there's the court charges on there.I found the £100 a bit strange but never thought this could be off the back of the CCA I sent to Arrow. I'm confused with the check the dates if I'm honest??I think I'm just going to send the CPR 31.14 request on Monday recorded and see what I get from that-is it 12 days they have to respond?I can't work out the deadline for my defence.Plus is there a thread which gives me examples of what to do nearer the time. The more I think about it they knew I was desperate to prevent a CCJ so probably Playing on my panic and then didn't expect a CCA through the post.
I will await the Tomlin arriving but they didn't mentioned a date it had to be signed by-I will stay off the phone to them from now on.

Plus when is the latest I need to send my defence if the court letter is the 27th October

Is this the Issue Date? (on the court claim form)
