    Hi Nem,

    Many thanks once again - I have now received a response from Restons - they state the following:

    As we have confirmed on several occasions, a delay often occurs in the provision of documentation, as our client has to revert back to the Claimant, who in turn has to revert back to the original creditor.

    We would however point out that proceedings were stayed on 8 December 2015 and have remained so.

    We note your intention to apply to the court for the claim to be struck out. It is the Claimant's position that the making of this application will be unnecessary.

    On this basis any application to strike out the claimant's claim will be defended and the costs associated sought from you.

    What on earth does this mean? Why is the application unnecessary? The whole letter has confused me!!

    Thanks in advance - this is really very much appreciated.

      Hello Anders,

      Restons / Cabot I think are " upset " to say the least that alleged debtors are fighting back a year is more than enough time to acquire any documents and in my opinion it's unreasonable to leave this hanging over a litigant in person life.

      If the fee is possible for you (£255) I think you could win on that basis.

      Careful consideration needed.

        When I lodge, can I claim for time spent in preparing the application or just the cost of lodging?

        I am going to do this but want to confirm if I can also claim admin and legal costs for preparing the application.

        Can you please let me know if there are any templates?

          No template that I'm aware of Anders.

          Claim the court fee and solicitors fee if using a legal rep.
