    Particulars of Claim: asset collections and investigations claim this amount in respect of an unpaid loan funded by uncle buck ltd. the defendant failed to abid by the terms and conditions & ACI purchased this debt from 1stop recoveries and subsequently sent notice of assignment to the defendant . the defendant failed to respond thus denying defendant any oppurtunity in assisting to bring matter to amicable conclusion

    One of the Beagles will guide you with this PDL claim.

    Since this involves Uncle Buck make sure you ask to see a copy of any Default Notice they claim to have issued since that's something they may not have got right before selling your account.

    I've seen other similar claims (where the original creditor was Uncle Buck) where that's been the Achilles heel

      right then I filed a acknowledgement of service and sent the cpa & cpr to ACI with no reply I originally thought this debt had been cleared but contacted original creditor who have confirmed its hasn't and was infact sold on, I have received nothing from asset collections regarding this account only a email buried in junk folder from 1st stop back in march asking me to call them. no default notice posted on my credit file regarding this account phoned court today and i have till Tuesday to either register defense or return the admission form to ACI with my offer of payment.

      Ive phone ACI to ask why they havent replied to my letter and they have said this is becuase they are no longer dealing with its a a litigation company based in blackpool now deal with it (my mistake as assumed they where same company) but claimant is asset collections & investigations glasgow address for document to be sent to is ACI Blackpool.

      ive currently set a dmp up with stepchange to sort out my remaining payday nightmare (got into the payday trap 4 years ago bouncing from one company to the next untill my entire salary was being taken each month and finally canceled accounts and dealt with most myself but theres a number of companies flexing muscle atm so gone to stepchange for help)

      what would people advise is my best way to now move forward can they seek a ccj when no defualt has been lodged? or should i just send form to them with my offer to pay?

        Rule No 1: never contact the Claimant by phone (or anyone else involved except the court). You need a paper trail, ideally one which includes letters or emails from them admitting they haven't got the paperwork you have formally requested.

        If you file a Defence (someone on the forum will help you to do that) you will find it easier to negotiate afterwards if that's what you want to do. The Small Claims Court offers free telephone Mediation if the Claimant decides to continue with proceedings after they see your Defence.

          Your defence needs to be filed by Tuesday ( Claim 11th Aug) . You sent the CPR and CCA requests, and haven't had any documents in response, in which case I think you can keep things simple for the moment with the basic Defence Example - have a read through it and ask anything you need to, you can amend and post up here before you send.

          Can I ask when you sent to CCA and CPR requests and where you sent each to.

          It doesn't show on your credit file at all ?

          Also just checking with [MENTION=48934]Debt Camel[/MENTION]; if there's any other foibles uncle buck claims have ?

            No particular UB foible.

            Standard debt advice is to try to claim unfair relationship if a payday loan is taken to court for a CCJ. I haven't been involved in such as case... [MENTION=6]Amethyst[/MENTION] could you find out if any of the other solicitors who post here have done this?
            [MENTION=84589]rich23121955[/MENTION] could you give some more information about your borrowing from UB, was this the only loan or were there a series of loans before this?

            If you had a lot of payday loans from other lenders you should consider if you could make an affordability complaint and ask for a refund of the interest you paid, see http://debtcamel.co.uk/payday-loan-refunds/ for details. This isn't going to work with the UB one as the FOS won't look at a case which is before the courts

              It doesn't show on your credit file at all ? this is from clear score regarding uncle buck.

              tried to ans what I can in like I say the only entries on my credit file shows a settled account no where does is say its defaulted and there is no record of either 1stop recoveries or asset collections or a default will this help my defense and if so how do I go about it can defense be filed online and do I have to attend court ( getting time of from work very difficult and im due to be out the country for 14 days after the 24th of sept)

                just checked check my file and its same story nothing from ACI or default from uncle buck it just shows as settled
