                        Do you have page 7 of the claim forms from the court ? You need to complete box 3 if you wish to defend, send to the court and then attend court on the 29th.

                        Firstly though, Have you sent any requests for documentation to the claimant? You do need to send a CCA request to the claimant CCA Request asap. This can form the basics of the defence, but if there is anything you can tell us about this welcome loan, and subsequent payment plan, that would be useful in determining what/how strong a defence you may have.

                            I did have a car loan and a payday loan but I can't work out what this one is. I have sent today (12/09/16) a CCA request to Cabot Financial.
                            On page 7 of the summons do I state that "I intend to state a defence" ?

                              Yes you'd put that you intend to state a defence. I'm not sure how much room is there is in the box and whether you put a full written defence with it as well as attend the hearing, so if you could do a pic of the page that'd be good as Scots court forms aren't something I deal with very much. [MENTION=87380]Diana M[/MENTION]; should know more about it.

                              At the moment it is a defence that the claim is for a debt which you do not recognise and the claimant has provided no information or documentation to back up their claim, and thus you have been unable to properly assess your position.

                              Welcome Finance is usually home improvement type loans rather than car or payday - but you maybe took a loan to help buy a car, rather than taking out a specific car finance?

                              Do you have any recollection of the repayment arrangement at all ?
