  • Cabot - Bailiff visit

    Hi all

    Whilst I was out this morning, I was visited by a court bailiff - I rang him as soon as I got home. He said he had to hand deliver forms from the court regarding Cabot.

    The forms are means forms for my income and expenditure he said. They were trying to hand deliver them as I had not returned the originals to the court.

    I have not had anything from the court (been living at the same address the last 3 and a half years) He couldn't give me anymore information other than he would pop in next week.

    I am assuming if the court are sending me means forms then this had already gone to court and I have no way now of defending myself? Anyone had any experience of this?

    Have you checked on your credit file to see if there is any judgment CCJ registered against you at all ?
    These could be attachment of earnings, statement of means forms if there is. Cabot would be a civil claim, so county court, rather than a fine through magistrates court - so likely a credit card/loan type debt.

    You could try giving the court a call ( Northampton county court business centre) to try see if they have a claim against you at the moment, but they might not be able to help without a claim reference.

    If this has already gone to court then once you know what it is you can look at possibility of applying to set aside the judgment and defending the claim.

    Let us know anything you find out and I'm sure peeps on here will be able to give you a hand dealing with it xx

        Okay so this is for £1303 - its from a Vanquis debt. It went to court two years ago at my old address - haven't lived there in years.

        So they have now found my new address and the court have sent me an income and expenditure to fill in. There is no arguing that I owe the money and I am willing to pay it back but don't really want it taken out of may pay - would happily send up a standing order. Would the court be likely to consider doing this if I explain this is the first I have heard of the judgement?

        Next question is I don't really have much disposable income at all. How long are the court likely to give me for this kind of debt, I heard they only give you 6 months - That would leave me seriously up against it - I think I only have about £15-20 spare in my budget and with two kids that doesn't tend to last long.

          If it were me I'd investigate this further.
          For instance, it could have been statute-barred (not paid into or acknowledged in writing for 6 years or so prior to the court claim).
          If so you could have successfully defended it.

            Unfortunately at the time it went to court it wouldn't have been statute barred.
