    Yes and don't forget to include your full name, address and any reference number they have for you.

    I would head the letter ''Formal Complaint'' and begin by saying ''This is a formal complaint for which I expect you to issue a final response within 8 weeks''.

    That way if they reject it you can then take the complaint to the Legal Ombudsman.

      Yes indeed, and add in the bits that EXC has mentioned too so you have the option of taking it to the ombudsman after they respond.

        Sorry Guys .

        I have not kept in touch about this problem
        and now its gone Tits up again

        I sent the letter off to bank smart as I was advised by you guys .
        they got back with a massive letter of rejection for what I had sent in to them
        then 10 days ago I got another court letter

        I am sorry ,I thought this would go away ,but it didn't
        I understand if nothing can be done now

          Ok we need to take the complaint to the Legal Ombudsman and do it quickly as we only have 6 months from the date of Bank Smart's rejection letter (which would have been around August) for it to be accepted by the Legal Ombudsman.

          Please e-mail me Bank Smart's rejection letter (I'll send you a private message with my e-mail address) and I'll help you draft the complaint to the Legal Ombudsman.

            Hello .

            I have already got in touch with them offering £50 a month .
            they only gave me until 19th to reply

            it was my cock up ,I thought it would go away
            now I am paying the consequences

            Defend Claim - within 28 days from Service (IF you acknowledged in time)

            If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
