    Good morning,

    The judge will decide on the evidence before him/her and you will receive a form " General Form of Order or Judgment" which will tell what the result of the hearing was.

    This is should reach you within 5-7 days after the hearing I hope this will be good news!!

      Send a copy to the Claimant as well, you are obliged to inform the other side that you may not be attending, and the description of your circumstances is likely to help anyway.

      You can telephone the court the day after the hearing to ask what happened.

        Today is the day!! It's set for 12pm according to the letter I received. Nervous!! Lowell had until the 26th May to file what was asked, I haven't received anything in the post does that mean they didn't file anything? Can I phone the court to find out or should I wait until after 12 to find out the results? Thank you again for all your help. I am really praying this goes my way!

          It's certainly worth checking with the court now.
          Lowell and its " solicitors" have a trend of submitting late and seeking relief from sanctions for so doing.

            I rang the court at 1pm and was told that Lowell hadn't filed any documents but the court had received my letter. The court clerk told me the judge's decision would be typed up (usually around 1-2 weeks for me to receive) but that the judge could choose to either give Lowell more time to file paperwork (but he didn't think so in this case) or he would dismiss the case. He said to just be aware the Lowell could lie and say they got the CCJ and a warrant as has been known in the past, to stall them should they try anything on and wait for the judge's letter. So I guess I just have to wait for the time being and hope :-) Will let you know once I receive formal judgement.

              A court officer has said " Lowell could lie"?? Now that is unusual!!

                Yep, I asked is there anyway I could find out sooner than the 1-2 weeks for the letter to arrive what the outcome was and his response was "Lowell may write to you, but be cautious because they may not be telling the truth" so best to wait until the court letter arrives!

                  Just to update, late this afternoon the post came and there was a copy letter from Lowell solicitors to the court stating they wish to close the case, dated yesterday, so I presume they got it into court at the very last minute. Thank you so much for your help, it is a huge weight off my shoulders.

                    That's great news, glad it's finally sorted for you xx

                    Did they enclose a copy of the notice of discontinuance ? Might still be worth checking with court in a few days if you haven't received anything from court directly.

                        That's great news Needing help!!

                        Lowell and it's in house " solicitors " are being seen to treat the court process/system with contempt!

                        Can we see a copy of Lowell's letter please?

                                Hi Nem,

                                I am needing help again re Lowell. So they sent me a discontinuation notice on the 2nd June, which was filed with the County Court on the 1st, (it was going to court on the 2nd if you remember). Last week I received a letter from Lowell asking for medical evidence of my illnesses, I ignored the letter thinking that it must just have overlapped in the postal system. However, today I have received a copy of my CCA (which proves statute barred in any event) but they are saying they will continue legal proceedings against me if I don't phone them with a proposal of a repayment.

                                So I phoned Lowell and I told them I had received notice of discontinuation and that I had checked with the Court and they also had received it and the case was closed. She put me on hold for about 10 minutes and then comes back and says, "we have no evidence of a notice of discontinuation on your file, but a hold will be placed on the account while we check with the court". I told her they can check what they like but I won't be replying to anything else and should they continue to harass me I will seek legal advice and take them to court for harassment. I am infuriated. What should I do now, do I write to Lowell with a copy of the notice of discontinuation or do I now just ignore all correspondence from them?

                                Cannot believe them!!
