  • I had MKDP struck out 18months ago now come back to haunt me as Hoist & Howard Cohen!

    Hello Everyone,

so i had a case made against me by MKDP in April 2014, i had it thrown out in October 2014 and the whole story is here:
    http://legalbeagles.info/forums/show...aim&highlight=

Now I'd forgotten all about the vermin, until today when what drops through my letter box but the apparently familiar letter to a lot of people on this forum of 'we've applied to the court and substituted the details from MKDP to HPH2(who are MKDP in disguise, am I right?)
with a court order attached to it.

The short of it is I'm now fully disabled and mentally ill, I'm not going through this all over again, surely they cant re-open the case now this amount of time has gone past? I know they will try most things hence what they've done now, they lost the case so I want them to well...get lost!

Any help would be very appreciated :tinysmile_grin_t:

Hi yes the Compelo group MKDP/MKRR et al and Hoist and it's arseociates are one worm ridden mass now.

Although the claim in your case was struck out the debt still exists and remains pursuable by Hoist et al.

It's unlikely but not impossible for them to try again but time has lapsed and judgement made on the claim so it cannot be revived.

Keep that Court Order Safe Eskimo.

From reading the original thread Nem ... it looks like the 'debt' was SB'd at the time of the first claim anyway :noidea:

            ,

            It does seem so.
            res judicata applies anyway.

My guess is that some inexperienced desk jockeys have been told to sort out all the assigned accounts from MKDP to Hoist without regard to the status of those that have been through court i.e. a bloody mess.

Worth a "nice, polite" letter telling them where to go??

Hmm to do that they must have applied to reinstate the claim as well as it was struck out in October 2014.

Therefore you will need to respond to them to inform them of that fact - let's see the order that HC included with their letter first though.

Yes but if they have a court order ( as is stated in their letter ) then the court must have changed the details on the claim ( which was struck out ) so we might need to check with the court the claim hasn't been reinstated in betweeny times.

Okay that's a generic order for a whole list of claim references. I would still call the court tomorrow and give them the claim number and ask the current status as you have an order stating it was struck out in Oct 2014 but have received this order from the court about a bulk change of claimant to Hoist etc and Hoist have told you yours is included... See what they say then we can go from there.
