    Hi there, have been a reader of the forum but only just joined! So hope someone can help me. For reference UB = Uncle Buck / DRC = Debt Recovery Comp

    I too out an Uncle Buck payday loan of £525 and missed the repayment of it, at the time I had 6 payday loans I was juggling, was in a very bad place financially and have managed to pay some back but not all. The interest repayment I last receive from UB was £708.49 on the £525 loan and then the most recent statement they said closing balance is £1008.27.

    Today I received a money claim online in relation to above Payday Loan for £1008.27 _ £70 court fee.

    It's to do with Uncle Buck, but they are not the claimant, the claimant is a debt recovery company. The particulars of claim state: ""DRC claim this amount in respect of an unpaid loan funded by UB. The defendant failed to abide by the terms of the contract. "DRC" purchased this debt from UB and subsequently sent a notice of assignment to the defendant to advise. The defendant has failed to respond to any correspondence or communication from the claimant thus denying the claimant any opportunity in assisting the defendant in attempting to bring the matter to an amicable conclusion."

    I don't know where to start or how to fight this. I was trying to set up a repayment plan with UB but they wouldn't give me one. Since the DRC contacted me I've been asking for more information on my account, statements of my account etc but they haven't provided me with anything, they state above that I haven't responded with them but I have.

    I told them that I would only speak via written communication yet they failed to also do this by constantly ringing my work phone. I made a specific complaint to the DRC and then was asked to send this to UB, which I did (in response to interest added to my account and was looking for some sympathy on how many loans I had out yet they still gave me one. The DRC said my account is on hold until I hear back from UB. Again no reply from UB, then I hear back from DRC stating that they haven't had any contact from me. The last time I heard from them was an email 11 days ago again stating they hadn't had any contact from me and then the MCO arrived

    How am I best to respond?

    First step would be to acknowledge service of the claim form - you can do that through MCOL and just register your intention to defend in full.

    This will give you a bit of breathing space.

        Could you possibly do a list ( sorry) of the PDL's you had at the time you opened the UB one and approx amount and vague summary of your work/income circs at the time?

        ( and as Nem has asked what's the name of the debt company / claimant on the claim form )



        Just some notes:

        Harrassment
        statements on account showing how sum claimed was calculated
        copy of credit agreement + terms ( nb. https://www.unclebuck.tv/pdf/ucb%20l...20document.pdf )
        default notice
        notice of assignment
        coopies of previous comms
        refused to accept payment arrangement
        irresponsible lending ( credit checks/affordability)

            I was contracting and self employed at the time between jobs with a mortgage. salary would fluctuate month by month £1000-£2000 p/m

              That's okay, same dca's as usual with UB.

              so: Acknowledge the claim
              Standard CCA request
              and
              CPR request
              as per - http://www.legalbeagles.info/forums/...it-Court-Claim

              We can also write another letter to them asking for full breakdown of the sum claimed, transactions / charges etc

              Then see what comes back from that ( probably more texts/calls tbh - keep a diary of them if you can)

                    How long do I wait for them to respond (if they do respond) before I can then try and submit some form of defence?

                      Your claim issue date was the 3rd Feb so you need to put your defence in before the Monday, 7 March 2016 - no responses at all yet then ?

                      Should start putting together your defence but not put it in until probably Thursday/Friday before the deadline, just in case anything turns up.

                        Hi there, just need some further help on this now please?

                        I submitted my defence on the timescales set out and then received a DQ form which again I filed. Didn't hear back from first stop recoveries so entered my defence. Since then, they've filed there DQ and then I received some account paperwork from first stop with some UB account info and some default letters etc... All addressed to an old address I lived at, but I had notified UB of my new address and they weren't using it! This came well after the time frames/deadlines set in order to file my defence.

                        This claim now states it's been transferred to my local court. What should I do next? I don't owe the extortionate amount they are claiming (it's nearly double my original loan)! and I certainly don't want to pay them. How can I fight them?

                          We'll need to see what you entered as a defence and the docs they have sent ( redact your personal details before posting anything) Was one of the documents the original credit agreement ? ( presumably online agreement ).

                          Do you have evidence of informing UB of your change of address ? ( email / letter etc ?)

                          Have you repaid the actual amount you originally borrowed from them ?

                            will post my defence shortly - was an online orig credit agreement.

                            I paid the amount of the loan which was £540, but they are stating I owe £1008. I have bank statement highlighting this fact.
