    I've received a CCJ today from the above for a PDL. I have never received a default notice, nor a LBA. I have however received a barrage of texts from this company

    I want to defend - whats my chance?

    You've received a county court claim form, from Northampton county court business centre.. the claimant is a payday loan company. I'd expect you have a decent chance to defend, but will definitely need more info about the claim to have any better idea than guessing.

    :...when was the loan taken out?
    :... how much was it for ?
    :... when was the last time you contacted the pdl company, and when was the last time you made a payment?
    :... have you been responding to the texts ata ll?

      Hi, thanks for your reply.

      The loan was taken out in Aug 2015, it was for £500. Never received anything at in from them in writing and I've never replied to the texts.

      Particulars of claim are:
      "The claimant is and was at all material times in business as a lender providing short term finance to consumers. By a regulated credit agreement made, in writing, between the parties on 10/8/15 the claimant agreed to advance the defendant the sum of £500 and the defendant agreed to repay the said sum together with the further sum of £198.64 in 3 monthly installments of £232.88 in respect of agreed contractual interest with the first installment due on or before 30/08/15. in breach of the agreement the defendant has failed to pay the sum of £232.88 due on 30/Aug, Sept and Oct/15. Despite numerous requests for payment, the defendant has not paid the claimant the sum of £698.64 or any part of it. The defendant therefore owes and the claimant therefore claims the outstanding sum including charges and interest for missed payment"

      Just to clarify I've not received anything from them, not any letters, a default or request for payment!

      Please help me :-)

            they do have a consumer credit licence, and check out on companies house.

            This barrage of texts - what do they say ?

            How did you sign up for the loan - internet on their website ? cashfloat.co.uk ? I can't see much precontractual information or the full terms and conditions on the website.

            did they email you with a copy of your agreement or post one to you when you made the application ?

              The texts were reminders saying someone from collections would be calling to my home etx - not nice texts

              I signed up for the loan online cashfloat.co.uk

              I don't recall getting a copy of the agreement by email or post and I definately did not sign anything

                Perfect. The text messages might come in useful so if you can screenshot them and save them that would be a good idea.

                Have you acknoweldged the claim via moneyclaim online ? If not go and get that done - then send a CCA request to the claimant, and a CPR request to the solicitors - see here http://www.legalbeagles.info/forums/...it-Court-Claim

                  Yes I acknowledged this morning online

                  I'll get straight onto CCA and CPR

                  If the MCOL is dated 22nd Jan when does my defence need to be done by? and more importantly - what do I write?

                        I've still had no response from them following my CPR and CCA

                        Also, I noticed on my credit report, the balance has been changed to £0

                        What should I write on my defence which is due this week?
