    I started the thread for myself and it's being over run by other comments for other people, which isn't helping myself as this my first county court claim so if you can refer to your original threads much appreciated.

Im not sure on the latter part of the letter perhaps someone else will help but me personally Id wright to them and advise that "I do not have such documents in my possesion and would be greafull for the info to be sent" but get advise from another member here Howie

              Write to the court and notify them of the extension, get all your paperworks in order and wait for the CCA responce, remember no CCA no action..!! and that last letter is a bit bewildering and needs a looking at for more clarification sure someone will be able to reply very soon .....

                Indeed, let the court know by email that the parties have agreed an extension (http://www.legalbeagles.info/forums/...filing-defence) and you can respond to the letter to state that you do not have copies of the documents you have requested in your possession. ( Do you have anything?)

                Also in the letter remind the solicitors that you have also sent a formal CCA request to their client and their client has indicated they are unable to provide such at this time.

                  I have emailed the courts and had a response stating can take 5-10 days to reply and take effect.....?? I did try calling them but i think their having trouble with the phone system there, does anyone have the correct number please ??

                  Ive also posted a letter staing that i have no documents or any copies and also that a CCA has been sent and they stated that no indication to provide at this time also...

                      Hi All

                      Just spoke to the courts and they have stated that my defence date would be the 16.01.2016 but as that falls on a saturday they have given me until the 18.01.2016 so fingers crossed that the CCA comes back with nothing or the debt is staute barred and i can just move on from this (wishful thinking) ..

                        Just a quick update it's been exactly 3 weeks since I sent the CCA template letter and the CPR letter to which 28 days extension was given, I only received a reply from the CCA asking what documents do I have in hand too which I replied none whatsoever.
                        I got too file my defence a week today and if nothing is received ie copy of Agreement what's the best format of defence on the MCOL please ??

                        This is my first ever experience in doing this and all or any help and guidance is highly appreciated.. [MENTION=6]Amethyst[/MENTION] [MENTION=69750]stu82[/MENTION]

                          Hey Howie if you haven't received a response to your CCA request don't chase it as if they don't respond its a good indication that they don't have it and therefore can't win against you until it is provided and you must ad this to your defence... Unfortunately Howie at this moment im as new to this as you and can only go by what I was advised in my case, take a look (link below) in the mean time until someone better can advise it may give you a good indication of what to do next....

                              CCA request time scale is 12 + 2 Working Days no weekend and bank holidays count.
                              CPR 31.14 is likely to be declined on the grounds that the claim will be allocated to
                              the small claims track.
                              You do not disclose any document you may have in your possession.

                              Reply along the lines of.

                              Sir/Madam,

                              Claim No.................................


                              I am in receipt of your letter dated.................................... im which request disclosure of documents which I may have
                              under my control.

                              Please not what I may or may not have received in the past is irrelevant to my request.

                              Any such documents will be disclosed as and when required within the progress of this claim.

                              Please forward the documents requested within 7 days of the date hereon.

                              As you are aware CPR 31.14 applies to this claim as it is as yet not allocated to any track.

                                Thanks for your reply, as for the CCA its now been 14 working days with no response, and as for the CPR letter i had a reply and i was granted the 28 days...
                                I spoke to the court as mentioned above an the 16th January 2016 is my 28 days up as it falls on a saturday i was told that i have until the monday, so just want to try and gain as much information and get the defence in place to submit on the weekend.

                                As for the letter of documentation asking what i had any in my possession, i replied with a copy of a Template from the forum and stated that i have no documents in my possession whatsoever..
