    I have received Claim for from Hillesden Securities Ltd T/A DLC...

    Particulars of Claim, Issue date: 02/12/2015

    The Claimant claims payment of the overdue balance due from the defendants under a contract between the Defendants and MBNA dated on or about July 14 2005 and assigned to the claimant,

    Particulars a/c 4129xxxxxxxxxx

    DATE : 10/11/2015 DEFAULT BALANCE £4081


    I remember I had a credit card from Alliance & Leicester but long time ago I paid of more then £4000 and credit limit was £3000 this is the interest they are charging I AM NOT SURE WHAT TO DO PLEASE HELP............

    Clarification please:
    1. have you acknowledged service of the claim and intention to defend ( do not enter a defence now). You can do this at Money Claim On Line MCOL) be careful to make a note of the password for this.. details are on the claim form N1.

    2. Is a solicitor involved?

    The next job after acknowledging service:
    A request under the provisions of sect.77/78 of The Consumer Credit Act 1974 to obtain a copy of the agreement relevant to the alleged debt. (CCA request) there is a £1 statutory fee to pay us a cheque or postal order endorsed " For Statutory Fee Only". the claimant has 12 + 2 Working Days to comply. there is a template in the forum library for this, use signed for post.

    Some history please, When was the last payment or written acknowledgment made on the alleged debt.
    Does this appear on your credit reference files? If you haven't checked try Noddle it's free on line.

      Thank you for replying, I have not done anything yet and on your advice I have just checked my credit report online there is nothing from MBNA the only thing I can see relating to this on my credit file is below.


      Hillesden Securities
      £ 4,081

      02/11/2015
      Default



      It says on the claim form there solicitor name Preston solicitor ltd

        I used have a credit card in 2005 issued by ALLIANCE & LEICESTER which has been closed down long time ago and I dont even remember when I made last payment but I think it was around 2006 or 2007.

                Yes acknowledge now, state defend in full ( don't put in any defence now)
                CCA goes to Hillesden, CPR to solicitors.

                      Ok I think this debt is statute barred, Hillesden/DLC / Cabot had portfolios of old A& L /MBNA debts.
                      We can try to finish this now ( whilst still preparing to defend.
                      My suggestion is to write as follows:

                      Private & Confidential
                      FAO Mr Christopher Ross - Roberts
                      Director Hillesden Securities#
                      Address as on the Claim form (N1)

                      Date:

                      Re: County Court Claim No...........................................:

                      Dear Mr Ross- Roberts,

                      I have received the above mention County Court Claim issued on date......... and have acknowledged receipt to the court.
                      I intend to defend this claim in full.

                      I have researched my credit history and have concluded that the alleged debt which is the subject of this claim is Statute Barred and was so barred on the date the claim was issued.
                      I remind you that the onus of unequivocal proof that the alleged debt in not statute barred falls entirely upon Hillesden.
                      I suggest that Hillesden now instructs its legal representatives to withdraw the claim in the interest of saving costs an court time.

                      Should Hillesden continue to pursue this claim it will be robustly defended.

                      Your early reply is required.
