    Hello Nem,

    Received the letter just before new year. However it's from Bryan carter not Lowells. Although debt is with Lowells.

    Shall I send the letter to Lowell?

    Also on the phone the person I spoke to said that the ccj wouldn't be set aside only satisfied which is not what I want. Any advice before I post?

          Hello

          So I posted the letters a few week back, one to Lowell and one to Brian Carter. Received a response from Lowell saying the account wasn't owned by then. This weekend I received a letter from Lowell solicitors saying they have taken over the account from Brian carter.

          They have rejected my settlement (Which they had offered in the first place) and also said they will not set aside. They also mention that I need to start paying the £50 monthly payment.

          Is there any chance I could still get this set aside on the below....

          1.Thought was statute barred so never thought to update address.

          2. I've tried to settle but been rejected.

          3. If I'd known about the court letters I would of replied.

          4. Initial loan was around 4K not 6k.

          Was saving for a mortgage with my wife and this has really been a kick in the teeth.

          Any help appreciated.

            Hello LPD,

            Please for clarity post a copy of Lowell's letter showing that the say they don't own the debt. Remove your name and Address.

                      OK the Lowell letter states only that they are unable to trace an account with the specific number quoted by you I presume?

                      Which of the two debts shown is relevant to the number in Lowell's letter?

                      You need to weigh up the cost of an application now court costs have risen the outline for set aside that you have posted here is " chancy " in my opinion.

                          Its neither of those debts. Lowell say they are the only 2 in my name.
