Only a judge can make that decision

It will cost you £155.00 to find out though

Sorry that makes no sense! I have no clue about all of this. So how would the full and final payment work?

"So how would the full and final payment work"?

The wording on any agreement will need to be very carefully worded to stop Lowell selling on any shortfall balance after accepting any short settlement

Onlky a court can remove the CCJ as it will stay on your credit file for a further six years

Thanks for the replies. My head is in bits with this. How would you proceed?

            Re: Unknown CCJ

First thing you need to put down is why you consider the CCJ was awarded in error and why it should be set aside

Sorry if it sounds like sucking eggs but please play along as this is no game and will impact you for a further 6 years if we fail to get it right

              Re: Unknown CCJ

If I had received the documents at my current address I would of tried to resolve this and make a payment arrangement. I didn't update my address as I assumed this debt was statute barred.

                  Re: Unknown CCJ

Thanks for that. I understand the part about asking this to be set aside due to me moving house. But would my defence just be that I assumed the debt was statute barred? Or that I would of made plans to repay?

Sorry for all the questions I just want to get this sorted properly.
Yes it is reasonable for not responding, it seems you're getting distracted here. Now Lowell's offer or £3.1K can you meet this? Do you want to try to
negotiate the settlement on the terms that they will agree to set aside the judgement?

Yes I could probably get 3k. But I don't want any comeback on this. And would it be possible to negotiate the settlement on terms that they agree to set the judgement aside?

Like I say I want to get it sorted best possible way at the lowest cost.

You would need to put together a Formal Conditional Offer of Full and Final Settlement .
Carefully worded and sent to Andrew Bartle ( he whose digital signature appears on Lowell's threat o grams.) the Chief Operating Officer of the Lowell Group.
