    Be careful with the income and expenditure form if/when it arrives - it could be deemed an admission of liability for the full amount.

      That's what I thought. Because if you are offering a settlement fee,why do they want you to fill out this form. Settlement fee is a one off payment agreed by both sides.

        Hi have just received the expenditure form from the solicitors. It looks very much like they just want to set up a payment plan. As note with it says.
        Please complete the attached income and expenditure form and return this as soon as possible in order to set up the payment plan. Then below there was a list of how you can pay monthly.
        So if I am offering them a settlement fee. Why would I be getting a expenditure form with the above note..as told them my Stepmum was paying it not me.

            No you don't. They have turned down your reduced settlement offer - if you complete the IE form it is for paying the full debt by installment, which I don't think is what you wanted to do?

            NOTE: If you receive a court claim note these dates in your calendar ...
            Acknowledge Claim - within 14 days from Service

            Defend Claim - within 28 days from Service (IF you acknowledged in time)

            If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
