    I have received a letter back from Carter stating that this is an Orange account, sim only, quote 'in which you opened the account at your current address', defaulted in 2012. and quote 'you have previously been provided with validation of the debt and you are referred to your own records for the same.' and I am offered a Tomlin Order or settlement.

    That is it and have no record of this and have never used an Orange Sim.

      I suggest raising this to a formal complaint along the lines of.

      Usual Refs

      Dear Mr Carter,
      Formal Complaint:

      I refer to your letter dated ............................... in regard to an alleged debt that your client claims owed by me.

      Please take not I am not now nor ever been a customer of Orange either as a contract customer or SIM only customer.

      It is of course impossible for me to refer to my own records for details of the alleged debt/account as I have never held such an account.

      I am sure you and your client Lowell are fully aware that you should not be pursuing an alleged debt when you are unsure if you are contacting the correct person.

      No validation with any merit regarding my liability for the alleged debt has been provided.

      I now suggest that you consult your client and urge them to withdraw the claim.

      Should Lowell decide to continue the claim it will be robustly defended.

              I will add that I want them to forward me a copy of their complaints procedure and that I am informing the FCA, as I am just sick of this. If they discontinue I will put in a claim for costs!

                Received letter from BC today - Discontinued !!! Complaint nothing to do with them, only following their client's instructions etc etc. I will ring the court to check as the hearing was due in 3 weeks time.

                      Notices are usually sent to you same time they are sent to the court. The court are usually a bit behind, but yes check with them again next week

                      Acknowledge Claim - within 14 days from Service

                      Defend Claim - within 28 days from Service (IF you acknowledged in time)

                      If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
