  • County court official stamp

    Have received a county court claim form from North Hampton County Court. But wondering if it is fake. As the official stamp is a photo copy. Thought courts official stamps were supposed to be real stamps

    The official stamp is usually quite crap and a photocopy. The actual form is blue but they often come out wonky and grey.

    Best thing if you aren't sure is to log in to Moneyclaim online ( details on front bottom right of the form ), or ring the court and check with them.

      I don't think there are many fake claims being issued, what would be the purpose? You'd soon find out when you tried to acknowledge service. Claims issued from the Northampton Court are issued electronically and get digitally printed so don't expect a real stamp.

      Who is the claimant and who are the solicitors involved?

        Well looks like it is real. The debt is 7 years old. The reason I stopped paying was the good I got was a bed frame and mattress. The mattress within 8 months was faulty. So on buying a 10 year guarantee I knew it was covered. Phoned dreams and mattress was replaced. Fast forward 2 more mattresses in 20 months. On third mattress was given a different one of same quality. But in 16 months same default. But when I phoned was told my 10 year warranty I bought is void. It apparently became void on my first claim as warranty was on the first mattress only. So therefore I was not going to pay for faulty goods

          The claimant is Cabot financial. The solicitors are Wright and Hassell. Did ask if they offered early payment reduction but no.

            Was this over the phone or in writing? Debt becomes statute barred after 6 years unless the debt is acknowledged. Phone call would not be acknowledgement but in writing may be.

                Statute barred means that after 6 years of non payment the debt becomes unenforceable. The are other conditions that apply, amongst them that the debt must not have been acknowledged. (If you are in Scotland then it's 5 years and the debt is extinguished).

                Did you get a letter before action? Have you acknowledged the claim?

                You have at least two possible items in your defence:
                1) The account is statute barred
                2) The account is in dispute.

                Wait for others with more experience to respond (but get the acknowledgement done!)

                In the meantime look through your bank statements, if you can, and work out exactly when you stopped paying.

                  yes I got several letters before action. But when I got the court claim letter I did call the solicitors. And did tell them that the debt is 7 years or more old. Was just told to fill out the claim form and send it back. So do I or not acknowledge the claim. As thought if I did that I am admitting it.

                    Don't send it to the Solicitors read the advice on LB and acknowledge claim and go from there unil they withdraw the claim,otherwise they will get a CCJ by default you cannot trust the Solicitor or DCA AT ALL

                        Debt over 7 years old

                        I have received a court claim on a debt that is probably 7 or more years old. Have since been told it is now statutes barred. So please how do I go about sorting this out as have 10 days until they issue a ccj against me

                          So what is the current situation? What is the 10 days about? They can't just register a CCJ, it has to go before the court.

                          Have you acknowledged the claim? You don't admit to the claim, you will be defending. Any problems with completing the forms please ask.

                          The defence is later, and it will be that the debt is in dispute and statute barred.
