    hi i have been have problems with bryan carter for some time now , and i have read most of your posts about it and followed them to , the court made a order on BC TO send a properly pleaded particulars by the 9/9/15 , to i received paper work from BC with a very bad copy of the credit agreement not signed , a copy of a default notice i never seen before and a copy of a letter they sent me which i never seen before to i have sent a email to the courts about the lateness of the paper work and i had to go and pay for the postage to .

    They have to be legible for a start

    How bad a copy is the agreement?

    What sort of credit is this without a signature, was it done online?

      hi thanks for thr reply its very bad and it states on the top of the agreement please sign and return and my name and address is handwritten and it has no dates on to

        Then you inform Mr Carter and the court that he has not complied with the order of the court.

        What is the date when you took out the agreement? (Year)

          Hi welcome to LB,

          It would help if you could post a redacted copy of the documents (s) you have received please!

          The CCA 1974 (as amended) requires the agreement to be "easily legible" in all parts.
          Were Terms & Conditions supplied with the alleged agreement?

            hi thanks for your reply please see photos the photos make it look better my name and address is hand written in with no date

              oh i have had some more docs a default notice which i have never seen and a letter with no header from who sent it saying jd williams sold the account on the 31/3/2014 but the letter dated the 19th june 2014

                i have sent a email to the courts stating that they haven't complied , of and the date that they are saying is 2009

                  In my opinion not easily legible.
                  What's this about the 2009 date clarification please?

                  BTW you Must adhere to court procedures you cannot just fire off e-mails about the claim.

                      No you must stick to the court process and follow the procedures set out in the forms you receive from court.
                      If the agreement is not compliant that is part of your defence which you have to complete and send to the court.
                      Random letters and e-mails will not be acceptable.
                      So your agreement started in 2009?
                      When was the last payment made?
                      What is the default date?

                        they state in there particulars of claim it was on the 21/08/2012 and the default notice they are stating is the 8/2/2013

                          Are you saying that the court made an order for certain particulars to be sent to them, or to you?
                          The 9th is only a week ago so it is possible that they did send the papers to the court.

                          Can you give us a bit of a timeline
                          You received a claim Y/N
                          You acknowledged service Y/N
                          You sent a S78 request ? Y/N
                          You sent a CPR31.14 request Y/N
                          Any replies?
                          You submitted a defence? Y/N

                          What exactly happened then

                          If you have the particulars of claim they might shed some light on the matter


                          No one can really offer an opinion without knowing the background.
                          The date of default would be useful as well

                            ok time line
                            claim yes 25th march 15
                            acknowledged yes
                            sent s78 and cpr31.14 request 27th march and on the 2/04/2015
                            yes replies told me to look at my records , twice
                            submitted a defence on the 19/4/2015
                            got a court letter for that phone call thing had the call court said cant do any think as i have had no paper work .
                            got a court order for BC to send a properly pleaded particulars of claim by the 9 /9/2015 but i did not get mine until today 17/9/15 and had to pay postage for it as they did not put the right amount on .
                            and thats as far as it is at this moment in time ,
                            hope it make sense

                              hi all i have a question

                              Bryan Carter Solicitors

                              are taking me to court on the 4th dec 2015, so if i pay the debt of amount it was before they started court proceedings would the be a end of it ?
