    This is in effect what is happening. They have threatened to serve notice at my business premise, similar to so many others. I am advised that this is not likely and not to woory at this stage because at worst I apply to have it set aside.

    Non the less, still a worry and reputationally i am not looking forward to a confrontation within my business.

      It would be a letter in the post if court - if they try a stat demand then it would just be a process server - pretty much like a courier delivering a package - I don't think they shout 'you've been served' or anything ... and the guy who serves it is nothing to do with the company at all.

      It would be an idea to write to them, if you haven't already, informing them the debt is disputed and why, it will help with the defence or set aside app if they do do anything. Polite/Reasonable etc - because you want to be able to show it to a judge so don't rant at them - always write letters as if they are going to be shown to a judge.

        Thank you Amethyst,

        I have sent a letter of dispute a few days back, and they replied saying they had answered an evidenced everything and that payment is due within a short period, else they would serve this stat notice.

        I have replied to this again today quoting the misrepresentation act as my prime cause for dispute. I have also ensured that the dispute notice had been received and noted to my file, requesting they advise their client (IME) also, which they have done via email and i have proof of mail delivery, opening and receipt.

          We are having the same issues with IME, just got the letter adding extra as 'late payment' and threatening us with an outside debt agency, can you let me know how you have got on?

            The first hearing for this is in court in August but Witness Statements are being submitted on Friday.

            If anyone who has been affected would be able to write a short statement about how the advertising was sold, whether the automatic renewal was explained to you and whether the service purchased was actually received, I believe it would be helpful to [MENTION=85007]bradley6051[/MENTION]. If he can defend the claim successfully then it can only be helpful to others who are facing threats of legal action.

            The other thing that would be very useful would be any emails or letters from the NHS trusts which confirm that staff benefits did not appear on their intranet.

              Hello. I have been conned my IME too. Tied into another 24 month contract when the original contract was not worth the paper it was written on. I have spoken to citizens advice and action fraud who are taking the matter very seriously. I was hoping the court action was an empty threat, but it appears this is not the case. I am glad to help in anyway I can. I was not made aware of the 24 month rolling contract and was specifically told by the rep that a, the ad would be available to NHS staff, and that they specifically work with the NHS, which is a lie, and b, that if I wanted to continue I would need to renew. Also the company has changed its name since I signed and the director owns at least 5 companies.

                Looks like INTERNET MEDIA EXPERTS (UK) LTD are heading for a compulsory strike off at companies house. The reason given is 1000(3) which is "Power to strike off company not carrying on business or in operation" possibly due to the failure to file their accounts by 30 April 2016 and failing to respond to enquiries from companies house.

                The case against @bradley6051 is currently still proceeding, for now., and he'd still appreciate any support you can offer.

                It does seem this is still the only case that IME have taken to court, so they are possibly hoping they win this one so they can use it in any future cases, or that the news they have brought a court claim will scare others into making the payments demanded. Of course if they lose it will backfire on them somewhat.

                  Internet Media Experts UK Ltd whose director is Lee Martin is currently the subject of a compulsory winding up by Companies House. They are being very aggressive in chasing money now but don't pay them anything - they will be out of business by early September 2016. The order was issued on 5th July and lasts 2 months after which time the company ceases to exist.


                  They have been chasing me and threatening me with a Statutory Notice.


                  According to the Insolvency Service (a Government Dept) a Statutory Notice is not enforceable if your debt is less than £5,000 so if you get one please do go to the court and ask for it to be set aside (a legal procedure). Because it is less than £5,000 you will automatically win and this company will have to pay both yours and the court's costs. This applies to individuals only,

                  If you're a company different rules apply but as long as you dispute the claim and can prove you have funds available to pay any debts then they cannot enforce the Statutory Demand and again you will be awarded your costs and they will have to pay court costs.

                  A Statutory Notice is not meant to be used to chase debts and the Courts take a very dim view of companies that do use them (even though they are legally allowed to)

                  If they sent you a letter stating that your contract was transferred to them check who signed it. Mine is not signed at all so not a legal document. You must also have signed for and agreed to the transfer for it to be valid. Internet Media Experts UK Ltd are very keen to tell you that that info is incorrect - ask Citizens Advice they'll tell you it's not.


                  They use a debt collection company called Commercial Debt Recovery (Maurice McCarthy or Becca). Both come across as friendly at first but soon show their true colours when you refuse to pay.


                  Tell them you dispute the invoice and they must leave you alone. If they keep calling you, as they have done with me, then get in touch with the police and report them for harassment. Keep a log of all your calls and texts, dates, times etc.


                  Also call Blackpool Trading Standards on 01253 478375 they are very interested in Commercial Debt Recovery and their tactics.

                    It's £750 for businesses ( just to add that bit as some of these ''bills'' are over that amount) but as you say you can return the set aside form to the court stating it is in dispute.
