    There's only 1 set of terms, the GE Capital terms, there aren't copies of the terms as varied (if they did) when it was transferred to Santander.

      They have not provided a copy of the Default notice or Notice of Assignment - which they are required to do - so those parts of your defence do still stand. Their case is stronger now they have sent the CCA though.

      They will have to apply to the court now to have the stay lifted and to proceed with the claim. If you wanted to try and negotiate settlement then you could do so now, without prejudice, as there are still some issues they need to sort out. When you receive the N180 form you could ask for directions to produce the Default Notice and Assignment notice.

          Hi [MENTION=6]Amethyst[/MENTION] the address I think is correct however the dates could be correct but as it was a while ago 2008 I think it's hard to remember. I have no statements from that time other than that I was supplied with from restons. That aren't of a customer type. If you know what I mean. They seem to be more list of transactions. Again this may well be a standard format to be supplied with. However in this format I suppose theyvod easily be adjusted to suit. I doubt this would happen but it's always a worry.
          Again any help appreciated in what to do next.

            @Amethyst the copy of the terms may well be a true copy but it was 2008 and i don't know. I don't feel very convinced to be honest.

                    I'm of the opinion that the recon agreement is ok on the origin as it was when the account was opened
                    But I can't see /reconcile any of this to any T's& C's relevant when the account was closed.
                    I think then that the recon is not complete.
                    I would reject the recon.

                      So it looks like I'm gonna be offering to pay? Which in all honesty I expected to.
                      However before I do what would you suggest my next steps are considering the possible irregularities with the t and c's .
                      I'm again at a loss as to what to do next in regards of offers or refusing the reconstituted terms thing and also having not received the assignment or default notice.
                      All help appreciated as I've got till November 4th to respond to restons and obviously I'd like to do it sooner.
                      Are there any templates I could use?

                        I would personally send a short note to Reston on the lines of:

                        Re: CC Claim No....................................... Arrow Global.

                        Dear Cur or Madman,

                        I am in receipt of the documents which Arrow Global Claims is a " reconstituted " copy of the agreement
                        relating to the alleged debt which is the subject of this claim.

                        Please take note this document fails to meet the requirements of a true copy a matter of which I am sure
                        you must be aware.

                        I respectfully suggest that Reston Invites it's client to withdraw the claim forthwith.

                        Send by signed for post, there still time before you need to respond.
