    I'm a bit concern as I hadn't filed a defence as yet, only an intention to - is this normal or has something gone wrong?

    The information I returned with the form was not more than a line or two asking for more time as I believe it was statue barred? I'm not sure I've offered any sort of defence yet?
    Oh B**ger it looks as if the court has taken your comment on the AOS as all you were going to say in defence it's not the first time I've seen this happen this week.
    A phone call to the court on Monday to explain what's happened and that you need to " fully particularise" your claim.

              I'm amazed that the default was lodged that late? I'm was unemployed and hospitalised almost 12 months prior to this - and I thought the 'clock' started from the last payment, not from the default notice? I'm lost.

              Nothing back from Lowell yet.

                Hello PJay Can we establish when the last payment was made on this loan, this is one of Carters favourite with Welcome loans as it's well known that Welcome always hang out on defaulting accounts for as long as possible and usually do it immediately before selling the debt on.

                We can mount a challenge with knowing when the last payment was made.

                  HI Nem,

                  I'm afraid not, I have no bank statements or anything and it's no longer on my credit file (which is odd given the date they claim the default for) I'm completely blind.

                  The last possible time I could have made a payment is June or July 2009 - almost exactly 6 years to the day... but that would be a guess - it's possible, even likely I would have stopped paying as long as 12 months before this time.

                    Do you want me to try and work on the fact that the account was defaulted unfairly late see if we can overcome this?

                          Just called them (on 0333 999 8930) they asked me for my name, DOB, former addresses etc etc - but they haven't got any of my details on file at all.

                          He asked me to call another recovery team (on 0333 999 8913) during business hours, but he doesn't think they'll have nay luck either as they work off the same database.

                          I'll call them in the morning and update.

                              I've spoken to Welcome now - their records are all over the place! I spoke to a nice (French I think) lady who told me that the debt is actually from 2007 - the last payment I made was August 2008 - it was sold to Lowell however in 2012. They have no contact recorded from me since Aug 2008 - default aside - this is statute barred is it not?
