      Did you pay a fee for a counterclaim when submitting via MCOL ? - paid it the Friday before, I can all court to pull it back. counterclaim on its way

        Okay the counterclaim is basically asking for costs, although there is a mention of damage to credit file.

        I'll have a read of the whole thing together later on and work out what your next steps should be - just have to go out for a little while.

                counterclaiming for loss and damages. last paid in 2008, but they sold refuted debt in 2014 knowing it was SB'd, completely out of order. that is why I am couterclaiming
                If the debt is barred by limitation then surely the same consequences flow for you too?

                Secondly, i cannot see where you could possibly raise a cause of action for the counterclaim, there is nothing which suggests to me that there is a viable claim.

                ive seen nothing here to suggest a counterclaim has legs

                Acknowledge Claim - within 14 days from Service

                Defend Claim - within 28 days from Service (IF you acknowledged in time)

                If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
