      CPR/CPA not received, I now wish to get my defence in, can I have some help please on how I go about this, can it be done online or the court claim form, also any advice on what to state regarding the non compliance from BC/Lowells? Thanks

        Have a go at adapting it to fit your circumstances and post up the result on this thread

              There is an example here http://www.legalbeagles.info/forums/...t-Court-Claims - nothing you can just print and stick in the post as every case is different - you'll need to read the instructions on that example and amend it as necessary, but generally fits most CCA moneyclaims where cpr 31.14 and cca requests have been sent and no documents received.

                  You should be able to file it online on the MCOL site where you went to acknowledge the claim. If you have trouble logging in it can be sent by email so there's no need to worry about running out of time if it's due on the 11th. :thumb:

                      Once they receive your defence, they have 28 days to respond to the court to say whether they wish to proceed with the claim, if they do, you will hear from the court. If they fail to respond the claim will be stayed, however, you will not be informed if this happens. It's a waiting game now :ranger: so time to catch your breath, relax a bit and enjoy what's left of the summer.

                                Mr Carter has been sending out those letters as a last ditch attempt at getting people to pay up because he must know that his clients will struggle to get their hands on the documents, so he's trying to see if someone bites at this stage. :nono: One to file under "C". :grin:

                                I'd just wait till you get the N180 directions questionnaire from the court. :ranger:

                                NOTE: If you receive a court claim note these dates in your calendar ...
                                Acknowledge Claim - within 14 days from Service

                                Defend Claim - within 28 days from Service (IF you acknowledged in time)

                                If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
