    Hi Guys

    sorry only me again, well my court date is on Monday and I have no idea what to expect or even what I need to do or say.

    any advice will be noted down and taken with me, I can confirm that I have had no correspondence no signed agreement or any documents sent to me.

      Hi,

      Have you received the claimants witness statement ( should have been provided at least 14 days prior to the hearing date)?

      Did you at anytime check with the court to see if the claimant had responded to your defence or ask if the claim had been stayed.

      The latter I think could be the case otherwise you would/should have received the document.

        After the court papers were received I had the offer above for reduced settlement but nothing since.

        Can I call them or do I turn up at the court

          What time is your hearing scheduled for?

          Check list Defence sent and acknowledged by the court and served on upon the claimant?
          No witness statement / documents from Cabot or their solicitors?
          If the hearing is in the early slot 10 am definitely attend court, if you have a pm hearing
          phone the court office 10am.

          The lack of communication from the court/claimant is worrying.

            Yes 10am

            I have had nothing since the letter they send offering reduced settlement mentioned above. I will attend and should I take copies of what I have sent requesting copy of the agreement?

            And what will they ask me and what do I have to say ?

              Yes take every thing you have with you.
              This is a puzzle no directions from the court?
              No contact from the claimant?
              When you received the notification of the hearing date
              the directions for what You needed to do would be on
              those papers, did you follow the instructions?
              Possibilities the claim has been stayed ( No Notification is sent)
              The court has awarded " summary judgement to the claimant. ( of which you would have notified.)
              I hope the claim has been stayed, you could ask the judge to strike it out if the claimant / representative
              fails to attend.

              Please let us know the out come as soon as you can.

                  Nobody turned up and the judge stayed claim explained they can do something to request reopen if there was a reason why they didn't meet the terms of the court notice.

                  Still not 100% clear what all this means but happy that no CCJ today

                  What's your take on this ?

                      Hiya Wardy, and thanks for the bump Joe. The silence is almost defeaning from their side isn't it.

                      The Judge will stay the claim and send them a notice which will give them 7 days to apply to set aside / vary the order. If they do not do that and supply the documents I feel you should be applying to the court to strike out their claim. I'm not really sure why he didn't just strike them out today. He will be sending out an order to both parties so see what that says.

                          The claimant will have to make an application to lift the stay and pay a fee.

                          You will get a notice showing the judges order in the post soon.
