      Oh, a Tomlin Order is an agreement to pay them out of court, and if you default of those payments they are entitled to just get the judgment from court and start enforcement. It's a way to settle without getting a CCJ.

      Just reading back briefly, did you ever send a CCA request or were you just relying on the stat barred argument?

        For info there was no contact after I posted my defence in June.

        I bet they are willing to settle seeing as they have been told the debt is statute barred.

          I've only used the Stature Barred argument as I know it's way over 6 years and no payments have been made since..

                  Defend Claim - within 28 days from Service (IF you acknowledged in time)
