I'm being pursued nearly £2,000 in the small claims court by Shoosmiths on behalf of Arrow Global.
My case calls next week and I'm more than slightly worried.
I can't remember the debt as its from ages ago, however I think I did pay them an ongoing token amount up til a couple of years ago. (they pestered me just after my husband died and I would have done anything to get them to stop calling me)
Once I regained the strength to sort out the finances I queried the debt I was paying them for and requested standard documentation. (client agreement, deed of assignation, account history and how the monies requested are being worked out etc...)
Thus far they have supplied me with a client agreement which is totally illegible other than a signature.
I am aware that overdrafts are somewhat exempt from certain sections of the CCA; however to be honest im not sure how any of this applies to Scotland.
Additionally I'm also aware that the exemption to the CCA for overdrafts, is based upon certain protocols being followed by themselves to retain the exclusion, which I've not yet asked them to prove as for some reason they seem to not know about the exclusion on overdrafts to the CCA.
Either way thus far they've gave me no paper work and im utterly lost.
I still don't know what the debt relates too and thus far they've given me nothing to work with and the case calls in a week.
I have copies of all the paperwork issued and can upload it here if you guys want to see, but really any help would be most appreciated; as im REALLY worried and very lost.
