    Haha, uncle Brian, first time I've laughed about this whole ordeal, so we'll done to you!

    It was really due to such great help I recieved from people here, they probably got so fed up with me, hell I got fed up with me! but yet still helped me and I'm really grateful.

    So does this mean they won't chase me anymore for payment, or is this just stopping the court claim?

    And do I still need to send lowell the medical info they requested?

      No case dropped no need to send anything, they could re-issue but would need a dam good excuse to, so do not get too drunk celebrating & have a peaceful weekend, others will no doubt comment as well, Carters usual stance hoping you give in then runs away when you do!

          Is there an actual Notice of Discontinuance attached? Sorry to ask, but you just never know with those guys.

          If it was me I'd also double-check with the court, I think there was a case here a few years ago where someone said they'd discontinued but they hadn't.

            I would still send your letter to Fred's as requested.

            Sorry I missed you other post about the defence pack password but glad you got it sorted with the court, even though as it turns out they are actually acting properly for once and dropping the case

              sorry for for the late reply ive been unwell lately.

              Mike thank you for making me laugh and your advice

              Amethyst thank you for all your help and this site was a godsend to me. I am glad my gut told me to not listen to step change who rusely suggested I do an inc exp and pay them what I can afford! I got my gp letter and this week will send to lowel/fredrikson. It is a good letter I think. Gp said I have chronic severe disabilities that make it impossible for me to work, and that stress exacerbates them further causing difficult to manage symptoms. That along side treatments and medication they advise me to keep stress to a minimum, so by chasing me they are Causing unnecessary suffering. And that she hopes they can look favourably upon my situation and cease pursuing me for monies I have no way of paying, as my income in completely from benefits and my health situation will not change. Obviously she worded it better tha me. She also attached a print out of all my conditions. That should keep them busy googling what they are anyway! Do you think this is sufficient to shut th up or should I also send my medical letters from all the Drs I've seen? There's around 30 letters.

              FlamingParrot, there is something that looks like a discontinuance of claim, it says that's what it is a notice of it. Do I have to sign that or anything?

                Are you referring to the same account they issued the claim for?

                      Bear in mind most claims issued by Lowell and similar debt purchasers are issued speculatively, hoping to obtain default judgment or, in a few cases, an admission. The majority of money claims issued end in default judgment for the claimant because the defendants either don't respond or don't even receive the claim form. When they find out they have a CCJ they remember an old debt they had and don't think about challenging it.

                      Companies like Lowell buy accounts in job lots without any details or paperwork so they wouldn't know themselves whether they are SBd or when they became SBd :confused2: and it's not always easy to find out from the OC who will no longer have an interest in an account they'd sold years ago. :thumb:

                      They can't be up to much, issuing another claim for the same account would amount to abuse of process, unless they could produce new evidence that wasn't available to them this time round, the chances of that happening are rather slim and they have thousands of accounts in their books so they'll be moving on to their next victims, hoping once more for default judgment.

                        Lowell or for that matter and DCA or debt purchaser will have no idea of the
                        status of a debt payments made or statute barred the data supplied when
                        debts are sold in minimal.

                          Thank you for the reply and all that info. Ive learnt so much on this forum from all of you. Its been such an eye opener and i feel a bit more confident now challenging these things. To think i nearly listened to step change and admitted it! Good job something niggled at me and told me otherwise.

                          So should i not really bother sending the med letter in now? I paid £15 for it so i guess i might as well put it to some use lol.

                            Thats very interesting actually. So they go in blind hoping people dont challenge and dont know anymore than they do. Bluffing the whole way. What an awful business. Will they sell this on now do you think or will it become statue barred? I cant be sure but i think this is the last debt listed. I think two credit agencies only showed this one so hopefully itll all be over!

                              Speculative pursuit of old debts in the hope that the alleged debtor will just pay up is very common, but fortunately these days the wider public is better informed and willing to seek help form sites like LB.

                              If Lowell try to sell this on ( which I doubt) they will need to disclose the "status" of the debt to the purchaser, there
                              are some companies lower down the debt collection " industry" food chain that will take a chance of spending a few
                              pence in the pound on such debts, but they are very easily seen off.

                                Unfortunately that's the way the official sources tend to deal with these matters, they don't think outside the box. They do help many people, no doubt about that, but there are many cases where people could have done much better by themselves. For example, someone from another site set up a DMP with them and in the first year, paid nearly £5k into it, yet his overall debt only reduced by less than £500 :scared: because none of his creditors had frozen interest.

                                It won't make any difference now, however, it may come in handy in the future if it gets sold on as you say, in fact even a debt that was ruled irredeemably unenforceable in court was later sold on!
