    Thank you again for responding to my question so quickly ....I left it blank and Lowell returned it to me but there was no urgent mention of paying the statutory fee on the letter just that they trying to get the original CCA again no mention paying it. So should I just leave it alone I am safe:tinysmile_hmm_t2: at the moment from Lowell.

            Answer yes to Small Claims Track.
            If the forms says " the claim is suitable for mediation" answer yes.

            Once this has been sent in the court will issue further form " directions questionnaire" for you to
            complete.
            Has you CCA request come through yet?

              Mediation takes place over the phone and if you haven't got any documents by then, the mediators will probably just say it can't go ahead but it's always a good idea to tick the box.
              You need to provide details of your local court under D1 and any dates you won't be available for a hearing (i.e. booked holidays) under D4. No need for expert evidence, only one witness under D3 (yourself) and you don't need an interpreter.

              Once you both parties return the forms, the court will give directions, including the requirement to provide the documents they intend to rely on at least 14 days before the hearing date. :ranger:

                            Hi I just got a letter from Carters saying that they did send a Notice of Assignment in around July 2013 and attached are the copies and they willing to settle the debt again should I just file this way and wait for the court direction to come:tinysmile_hmm_t2: throught...any help would be appreciate.

                              Have they sent you anything else, such as the CCA? Looks like Mr Carter is developing a new strategy and sending letters asking people to settle, you have to wonder why if he's sure of winning in court... :confused2:

                              I'd be inclined to agree with your idea of filing the letter and waiting to hear from the court. :thumb:
