  • Court form received but need something checking

    Hubby has a court claim form dated 19th feb 2015 received on 21st Feb 2015. Due to a family loss and having to get out the door quickly not thinking and not even opening the envelope i put it on the side to sort when we got back. We got back today ready to fill it all in as he does owe it just cant pay it in one go and it is already a judgement on 6th March at 7.18pm. I thought we had 14 (working) days + 4 postal days when i had to fill mine in a long time ago.

    Where they right to enter it on the 6th had he ran out of time?

    Hi,
    Please give us some details of the claim and claimant, and what the debt is for.
    I do not understand this " there is already a judgement on 6th March at 7.18 pm" can you clarify what document this has been provided on, e.g. General of Judgement, Judgement for Claimant in default?
    14 days from date of service to acknowledge claim.

      Date of Issue 19th Feb - they shouldn't really have been able to get default judgment before today (9th March) - so if you tell us a bit more as nem says, we'll see what you can do to get it sorted.

      First thing I would do is ring the court(northampton ccbc presumably) and ask them about it and point out the dates.

        Claimant is a parts/equipment company who used to supply hubbys business last year, we returned a few bits of equipment he had which lowered the balance in return but obviously it was second hand and left an outstanding figure on just short of £5k.

        He received a claim form from Northampton County Court dated 19th Feb on 21st Feb. We went online to fill it in today online and it says "A judgment has been entered against you. You cannot respond to the claim at this time"

          I agree with Amethyst the judgement is early.
          I have seen a few judgements by default being made
          by procedural judges after normal sitting hours of 10.00 hrs and 1600 hrs but
          to do this on the Friday afternoon when the defendant has until the Monday
          to file is not right in my opinion.

            Morning

            Sorry for the delay, he eventually got through to the court. Apparently he has offered payment and the claimant has accepted? He received an N30 for stating You have made an offer of payment which the claimant has accepted. It is therefore ordered that you must pay the claimant £4965.93 for debt and £305 for costs. Total £5270.93 forwith. This form is dated 6th March and he got it on 16th March.

            Not really sure what this means? I am just about to type a letter asking for proof of the payment offer and why the judgment was entered on the Friday evening, would i be right in doing so?

              Letter is going in the post tonight asking for the evidence of payment offer. See what he gets back.
